Show 2B The Salt Lake Tribune, jihesilab April 29, 1966 Aims for June Completion Di State to Press On in Emery Alining Probe By Paul Roily Tribune Staff Writer The state will continue its probe into allegations of waste and mismanagement by the operator of Utah Power & Light Co. mines despite L.P&L's decision to cancel the contract with the operator. Division of Public Utilities officials said during a news conference Monday they will complete the investigation of Emery Mining Co. and they believe the state still can force utility refunds to ratepayers if it is determined mismanagement in the coal Operations caused overpayments. The officials also believe the state has the authority to demand the release of Emery's contracts and other records to help in the investigation, despite the fact Emery no longer has a contractual arrangement with the public utility. Division Director Ralph Creer said the agency has recommended to the Public Service Commission that the investigation continue to its completion, despite the dissolution of UP&L's contract with Emery He said the investigation will continue unless the PSC orders it halted. .UP&L announced earlier this month it was terminating its contract with Emery because of problems surrounding potential liability in damage suits and the subsequent difficulties in obtaining liability insurance. F employee-compensatio- n laws exempt an employer from liability if a worker is injured on the job, but they do not exempt the owner of the facilities or property where the accident occurs. UP&L is the owner of the eastern Utah coal mines operated by Emery, but Emery employs the miners, so while Emery is exempt from liability, UP&L is not. By dissolving the contract with Emery and taking over the mines, thus becoming the miners' employer, UP&L obtains exempt status in liability suits and therefore becomes insurable at relatively reasonable premium rates, officials said. UP&L paid Emery $4 million to buy out the contract. The division's investigation centers 011 allegations made two years ago by James Simonelli, a former Emery employee, that waste and mismanagement in the coal operations have cOst. UP&L ratepayers up to $1 million a year since Emery took over as the utility's mine operator in 1979. The division's investigation is one of three probes of Emery Mining's contract arrangements with UP&L. Tina Utah Attorney General's Office and si Salt Lake County grand jury are also looking into the arrangements. Ken Powell, manager of the division's Electric Utility Section, said the division's investigation has cost the state about $250,000. He estimated spending another $100,000 before the probe is completeu, hopetully by June. "'But Mr. Simonelli's allegations contend the v:aste and mismanagement by Emery has cost ratepayers $1 million a year," Mr. Powell said. "If we can show overcharges due to those problems and obtain a refund, we are giving the citizens a bargain by completing the investigation. :We still want to know if Utah ratepayers paid more for their electricity than they should have for the last six years." Mr. Powell added. "If so, the division's report to the Public Service Robert S Campbell, a partner in the law firm of Watkiss and Campbell Commission will contain those findings and recommendations tor payment of refunds," Mr. Powell said If past overpayments are detected, the state will attempt to obtain refunds to ratepayers from the utility, "then UNA, may want to make a claim against Emery," The issue of whether the contract between Emery and UPtlit. should be continued is now mooted. 'But what violations or abuses that may have occurred and what immediate remedies may be available are still valid issues to focus upon in the investigation," Mr Campbell added.
