SALT LAKE TRIBUNE DRAPER — Before addressing the Utah Board of Pardons about the murders of her and son Jodi Tillett placed a framed picture of her son on the oard room table Then Ms Tillett began sobbing while relating how her Don Newingham and their son Shane Newingham 18 were stabbed to death She asked the parole board to Richard David keep Gabaldon imprisoned as long as possible for his part in the crime "He's got to pay his dues" Ms :Tillett said during the Friday hearing The Newinghams were killed June 10 1990 at a party at Gabal-don'Salt Lake City home Fred Alvarez 17 was SALT LAKE TRIBUNE Utah's new guidelines for determining mental illness in criminal cases have eliminated the insanity defense and are unconstitutional says the attorney representing a man charged with murder Public defender James Bradshaw told 3rd District Judge John A Rokich that the revised guidelines are "the most restrictive in the nation in limiting the right to plead insanity" He made his arguments Wednesday during a hearing on his motion challenging mental-healtprocedures for criminal defendants A ruling on the motion is expected Oct 30 "If my client changes his plea to not guilty by reason of insanity he must turn himself over to the Utah Division of Mental Health for an immediate examination and waive his constitu first-degre- sonnel bidding for the work Under previous law a defendant would be examined by two psychiatrists appointed by the judge and defense and prosecuting attorneys "The decision to appoint only one doctor on a contract basis is supposedly the result of a state decision that too much money was being spent on mental health cases" Mr Bradshaw said Dr Breck LeBegue a University of Utah doctor testifying for the defense said the current evaluation process sets no standards for the choice of a doctor and contracts with an agency rather than an individual reducing quality assurance Dr LeBegue said he hasn't signed a contract with human services because
