Solution to Problem The new jail wing seeks to circumvent that injuction by solving overcrowding, but a recent trend in jail population levels casts doubt upon the anticipated ability of the new wing to completely solve prisoner i rowding During the past eight months, the Jail, built to house 311 inmates, has housed an average of between 380 and 430 inmates. What it takes is a young man or woman who is m long-rang- Deputy Cleared in Shooting An undercover The shooting occurred when the officer drew his automatic pistol to arrest Mr. Scovel who was seated in a pickup truck parked near a health club at 1325 S. State. The Salt Lake County Attorneys office, as required by Utah law, is also investigating the shooting and its determination of the cause of the shooting is expected within a week, according to Sheriff Hayward. Mr. Scovel, who is in satisfactory condition at LDS Hospital, has been charged in 5th Circuit Court with one count of unlawful distribution for value of a controlled substance. He will be arraigned on the felony charge upon his release from the hospital, officers said. Law Protects State, Not Private Clubs Utahs new dram shop act doesnt give protection to restaurant and private club operators the way it does state employees, the Utah Attorney General's Office held Tuesday. The law provides civil liability for those who supply liquor to an individual who then commits an act for which he can be sued. Assistant Attorney General John S. McAllister wrote Liquor Commission Director Kenneth F. Wynn that the statute isnt inconsistent when it provides for potential liability of vendors yet protects liquor store employees and liquor commissioners themselves. Vendors those who operate state stores within restaurants and private clubs are not employees of the state even though they are agents running agencies" set up and licensed by the state, Mr. McAllister held. Vendors may not supply liquor to minors, any person actually, apparently, or obviously drunk, any known habitual drunkard or any known interdicted (prohibited) person, Mr. McAllister wrote. Protection from liability is granted only to the state, to the states agencies, to political subdivisions, and to their employees, the informal opinion said. Should the jail wing, as Mr. Triptow anticipates, be 80 percent complete by December, some prisoners may be able to be removed from the crowded jail to the new wing, still leaving the jail filled to more than its listed capacity. It would then be left up to the federal judge to decide whether a jail overcrowded by 30 inmates, for example, as opposed to a jail overcrowded by 100 inmates, still creates justification for federal intervention. If were still overcrowded by that many prisoners in December, I think we are going to be in trouble, Mr. Kaufman predicted.
