George Hansen last spring at least indirectly prompted his allegations that a federal probe into the congressmans financial dealings is an act of religious discrimination. Rose, a conservative Republican and Mormon like Hansen, has asked the U.S. Commission on Civil Rights to determine if Hansen is a victim of discrimination. He also claimed his civil rights are being violated because the Justice Department investigation is inhibiting Hansen from adequately representing him in Congress. An ally of the congressmans, Rose said he began considering the complaint after Hansen asked him to look into the background of Arthur Emmens of Dallas. He contended it was testimony from Emmens that triggered the federal investigation, and Rose also alleged that the Internal Revenue Service disclosed confidential tax information about Hansen. Rose said he did not charge the congressman for his work, which he did in Hansens Capitol office as well as outside. He said he kept in close contact with either Hansen or his aides while he was in Washington. The IRS has denied any improper activity. The Justice De- partment charged Hansen last spring with violations of the congressional financial disclosure requirements. Hansen has asked the U.S. Supreme Court to throw out the charges on grounds that the Justice Department has no authority to move against him in connection with House ethics requirements.-James McKenna, a Hansen aide, said Rose was never involved in any part of Hansens battle against those charges. They said tests showed the lawmaker had a level of 0.11 percent slightly above the 0.10 limit considered proof of intoxication under the states drunken driving law. But defense attorney David Nevin said Friday he has asked the state Supreme Court to stay the execution because he believes Judge Robert Newhouse violated state law. Nevin said Newhouse should have called Sivak into court when setting his execution date.
