Were trying to find spots for everyone." But tearful staff members, who say they were not formally notified about the details of the change, spoke of brutal treatment by management executives. Many staffers were asked to make an immediate decision to move to Washington. But CBS News will not pay relocation expenses except for a handful of top producers, they said. Furthermore, there is no indication how long Nightwatch might survive in its new format. By George Maksian New Yorn Daily News Writer After months of speculation, CBS News has finally confirmed it will relocate Nightwatch, its overnight broadcast, from its New York base to Washington, effective Jan. 2, in an effort to save money. An undetermined number of staff members will lose their jobs. The program will continue to air weekdays on KSL from 12 15 to 4 am. MST (the first two hours are live, the second two repeated on Felitape). But the four anchors cia Jeter, Harold Dow, Karen Stone and Christopher Glenn will leave the broadcast. Instead, there will be a single host still to be selected, according to CBS News president Ed Joyce Joyce sid that "key members" of the staff will be offered jobs in Washington. Some other staffers, he said, will be reassigned within the news division in New York. That means some will be let go, but no numbers were available. The Death Battle This is the death rattle of Nightwatch, one senior staffer said. Most people here feel the idea of moving to Washington and presenting dull political interviews all night is a terrible one. No one wants to watch that kind of thing in the middle of the night This is a textbook case of what happens when accountants get in producing a news broadcast, the staff member continued. Ann Morfogen, director of communications, said that the four an Sloppy and Crude At best, the handling of this was sloppy and crude a Nightwatch senior staffer sar.. At worst, it was sadistic and extremely shabby. When NBC News canceled Overnight this week, it was done with dignity, cleanly and surgically. The Nightwatch people were handled atrociously, and cronyism determined who was able to stay and who was let go. Sources indicated the program's I? million a year budget can be slashed to $5 million by moving to Washington. Jonathan Ward, the new executive producer, accepted the job Friday morning but was not told an announcement would be made the same day. Nightwatch was considered a stepchild in New York, Ward told a reporter. The program has had rough going ever since its debut Oct. 4, 1982. It started out as a live four-hou- r telecast. The live segment was cut in half last summer, and 20 people were fired. Talk immediately surfaced that the show would be cut to one hour, or canceled entirely. Mountain Bell Obtains A Reprieve The plaintiffs in a lawsuit seeking to prevent Mountain Bell customers from calling several New York phone numbers, which allegedly provide obscene messages, have been temporarily prevented from pursuing legal channels against Mountain Bell. Third District Judge Scott Daniels ruled Friday that the plaintiffs must halt legal action against the phone company until after the FCC makes a ruling on the matter. The FCC is presently determining whether it can take any action against High Society Magazine Inc., and Car Bon Publisher to prevent the transmission of the messages. Mountain Bell had sought to have the suit against it dismissed, noting that it was not responsible for the children of the plaintiffs calling the phone numbers. Plaintiffs, who are listed in the suit by initials, contend that Mountain Bell should have known that obscene messages were being transmitted to callers. The plaintiffs are also suing New York Telephone Co , High Society Magazine Inc., and Car Bon Publisher. Robert B. Hansen, who represents the dozen plaintiffs, said the children were calling a number advertised in the shin flick magazine Live. He said the parents did not find out about the calls until they received bills from the phone company. He said some of the bills were several hundred dollars. Mr. Hansens clients are seeking $1 million in punitive and compensatory damages. They also asked a judge to order Mountain Bell to block calls to the number and issue an order that would prohibit the collection of money expended by the plaintiffs children m making the calls. Although Judge Daniels did not rule on the plaintiffs motions, he questioned whether it would be advisable to prohibit the collection of money and therefore make it possible for everyone in the Mountain Bell system to call the number free of charge. Ted Smith, representing Mountain Bell, told the judge the customer is responsible for payment of all calls. He said Mountain Bell is a common carrier and cannot pick and choose which calls it is going to complete. He also noted that the FCC, rather than Mountain Bell, decides what the tariff will be on longdistance calls. In court Friday, Mr. Smith argued that the suit against Mountain Bell should be dismissed. He also said he felt the issue should not be decided in a state court, but rather in a federal court. Mr. Smith also noted that he did not feel that it would be possible for his client to block calls to the numbers listed in Live. He said the company, at most, could block calls only to any numbers with the same prefix. This, he said, could prevent calls to as many as 10,000 other phone numbers in New York. Although the judge did not agree to dismiss the suit against Mountain Bell, he ordered the plaintiffs to temporarily discontinue their suit.
