Dan Marriott, will resume Wednesday in tht' House Interior Committee, the Congressman said Friday. Mr. Marriott's proposed amendment was sidetracked Wednesday when Rep. irTiiji insisted that it be Jim Santini, strengthened to focus on coal slurry pipelines (which use a large amount of water in transporting piberi2ed coal) rather than dealing with water use, generally. Mr. Marriott said Friday a compromise has been struck, after close consultation with Rep. Bob Eckhardt, author of the Coal Slurry Pipeline Bill stalled in committee over state water rights. We have protected state's water rights and have also opened the dxr for a reasonable coal slurry law, Mr. Marriott said. However, he said that while his proposed amendment would prohibit coal slurry pipelines outside of state law stops Congress from reserving water except where expressly provided, as in the case of public water holes, springs and designated wild and scenic rivers. Mr. Marriott said his state's rights position would have been strengthened by another amendment introduced Wednesday by Rep. Richard Cheney, the federal government from appropriating any water within a state for coal slurry pipelines, unless in compliance with laws of that state, a "stumbling blook yet to be resolved is the question of a pipelines authority to challenge a state's water laws." Under the Marriott amendment, the prohibition against the federal government appropriating a states water for but that Chairman Eckhardt Objected, saying the Cheney amendment would violate his compromise with Mr. Marriott.
