criminal deputy sheriff announced Thursday because only one shot was fired from the weapon He said that murder charges are contemplated against both men now held in the county jail on open charge Devich was wounded twice a block from his home at 8 30 p m Tuesday and died at 8 20 a m Wednesday He was shot after he was said to have conversed with Moore Smith William Palmer 45 and his son Leonard Palmer 15 both of Midvale concerning a settlement in behalf of May Palmer 22 daughter of W llliam Palmer Miss Palmer reported to be an expectant mother is a former sweetheart of Devich The German Luger automatic pistol which Moore has admitted firing was found at 3 p m Thursday by Deputy Sheriffs Michael Mauss and R C Jackson on the Jordan river South street bridge at Forty-eight- h the spot where Moore said he threw his pistol after the shooting affair Deputies also found a 32 caliber revolver near the bridge The automatic pistol had only one hot fired from it and a shell also was missing from the revolver said by tcputles to have been used by Smith Moore told deputies he fired his weapon after Devich was seen to reach for his hip pocket and after one shot was fired Devich was wounded twice and Deputy Carlisle reported that the two wounds were Inflicted by different caliber pistols He said that in his opinion the first shot which Moore admitted hearing was fired by Smith after which Moore also wounded the victim Deputy Carlisle reported that Devich was unarmed at the time of the shooting Depute Mauss said his investigation Indicated that the four men called on Devich after he refused to make a settlement with Miss Palmer earlier in the day The two went armed Deputy Mauss believes because they believed Devich would be armed The Palmers were released from the county
