Utah and the Sheriff Brant L. Johnson met with Marriott today in his Salt Lake Citv office to discuss the Missing Children bill (H.R. 6976) and both officials assured him that such legislation would greatly help local law enforcement officials in their efforts to locate missing children. A neighbor does something to further the enjoyment of his own property, but at the same time, unintentionally creates an annoyance to his neighbor. In this case, as in all nuisance cases, the interference with your enjoyment of your property must be both substantial and unreasonable. If you can prove these two elements in court, you have a very good chance of winning a judgment in your favor. Before going to the exnense of hiring a lawyer and initiating court proceedings to deal with a problem neighbor, it is to your advantage to try and talk to your neighbor and explain how he is interfering with your rights. Take the opportunity to suggest a reasonable solution to the problem, one that would be satisfactory to both of you. Another out-o- f court alternative is to ask a third party to act as a mediator. A mediator could either be another neighbor, the landlord or the local community association. There may also be a local dispute resolution center in your community. This is an informal center where a mediator tries to help disputants solve their differences without going to court. If these alternatives do not remedy the situation, write a letter to the party creating the nuisance stating exactly what the problem is, and giving them a specific period of time to amend the problem (usually 30 days). Explain that you will seek legal counsel if they refuse to act. The guidelines of what constitutes unreasonable intervaries from state to state and even from county to ference county. A local lawyer could tell you if a specific statute is being violated or how the local courts have acted on similar cases in the past. Often a strongly worded letter from an attorney will convince your neighbor that you mean business. If, as a last resort, you do go to court, you may receive either an injunction against your neighbor requiring him to stop his offensive behavior totally, or the judge will act as mediator and impose a compromise.
