Barnet Lubinsky, partner in the firm of clothing manufacturing New York Anselewitz & Lubinsky of and living in the Bronx, went through a unique experience. Lubinsky was arrested on the complaint of Bertha Lubinsky of Richmond Ind., that he was her father, who had deserted her mother in Indiana eight years ago. A warrant charging him with desertion was issued by the Indiana authorities and he was about to be extradited. Lubinsky claimed he was never in Indiana in his life. He has a wife and a son 7 years old, born to him in the Bronx. Through counsel he applied for a writ of habeas corpus to prevent his extradition. Accompanied by friends prepared to testify that Lubinsky could not be the deserting father of a family of five in Indiana, as charged, he appeared before Supreme Court Justice Tierney. Bertha Lubinsky had sobbed as she pointed at Lubinsky and exclaimed : You are my father. I now you are. Im sure of it. But Berthas mother, a small, modestly dressed woman, had come Richmond to make the PSU1Ve indetnlfiCatin She walked about the court rom, where Lubinsky was seated among perhaps 50 other men and finally stopped opposite him. He looks like my husband, she said. But, I am not sure. He is stouter and has more hair and4 I may be mistaken. But he looks like the fther of my five children. Assistant District Attorney Cohen and Justice Tierney learned from the deserted wife that her .husband had been operated upon years ago fo rappendicitis and had a large scar in consequence. Also, she recalled, he had a mole on his chest. Lubinsky submitted to a physical evami-natio- n and no such scar or mole was found on his body. After receiving the report, sobbingly and with many apologies to both the court and Lubinsky, mother and daughter departed and Lubinsky, set free, assured them he bore them no il will. , I Where You Can Buy The Cheapest The Peoples Store.
