Show r r i i SOUTHERN UTAH NEWS - Thursday, May 12, 1983 - Page Eight Public Notices AMENDED NOTICE OF INTENTION PUBLIC NOTICE IS HEREBY GIVEN that on thcl8lh day of April, 988, the City Council of Kanab, Utah (the "City"), adopted an Amending Resolution declaring its intention to create the "Kanab Creek Ranchos Special Improvement District (the District). It is the Intention of the City Council to make street Improvements within the District and to levy sccial taxes as provided in chapter 16, Title 10, Utah Code Annotated 1 953 as , amended, on the real estate lying within the District for the benefit of which such taxes arc to be expended in the making of such improvements. 1 the issuance of bonds and bond interest, except that interest may be abated by prepayment as explained hereafter. The property owner's portion of the total estimated cost of the improvements may be financed during the construction period by the use of interim warrants. The interest on the warrants will be included in the costs to be assessed to the property owners. No bid for less than the total amount of taxes, interest, penalty and costs which are a charge upon the real estate will be accepted. The improvements for the District include construction and paving of streets within the district including the original placement or in some cases the replacement of asplialt surfaces within the traveled way and also provide general drainage facilities; the placement of top soil andor sod; the removal of cutback (recessed) parking areas; the addition of property drains; the improvements specifically mentioned in the description of the work to be performed under Rates 1 through 15 hereafter set out and other miscellaneous work w hich is necessary to complete the improvements. The City Council will rescind its intention to create the District if protests have been timely filed representing one-ha(12) or more of die lots to be assessed after elimination from such filed Protests (i) protests relating to property which has been deleted from the district and (ii) protests which have been withdrawn in writing prior to the conclusion of the hearing. The Project will not proceed if Protests representing one-ha- lf ( 12) or more of the lots to be assessed within the District are filed and not eliminated by reason of (i) or (ii) above. The owners of lots abutting the streets described in this Notice and whose property will be improved will be assessed the cost of such improvements. Depending on the nature of the improvements, some costs have been affected by front foot of abutting property and common costs will be computed and distributed for assessment and purposes throughout the district. For a designation of the applicable rate and basis of assessment, see the Schedule of Improvements and Estimated Costs set out hereafter. A map of the District and rates for assessment are available for review in the City Offices. Also available is a list of all property owners affected and the rate schedule for each. Those property owners within the District whose properly does not abut the newly repaved streets will not be assessed. All oilier necessary things shall be done to complete the whole project according to plans, profiles and specifications on file in the City offices. All nonconforming improvements such as lawns, sprinkling systems, rock gardens, driveways, curbs and gutters, culverts, walks, fences, etc., which have been built or installed by abutting property owners within the area to be improved, must be removed by the property owners at their expense prior to the commencement of the project If these improvements are not removed by the property owners, they will be removed by the contractor and disposed of by him as directed by the Engineer. The purpose of the assessments and levy is to pay those costs of the subject improvements which the Municipality will not assume and pay. The method of assessment shall be by lot and upon the basis as setforth herein. Assessment may be paid by property owners in not to exceed fifteen (15) equal annual principal installments. Interest will accrue on the unpaid balance at a rate or rales fixed by the City Treasurer. The whole or any part of the assessment may be paid without interest within fifteen (15) days al ter the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to be derived by each property owner within the District. Other payment provisions and enforcement remedies shall be in accordance with Chapter 16 of Title 10 of Utah Code Annotated 1953, as amended. TIME 1 OR FILING PROTESTS Any person who is the owner of record of property to be assessed in the District described in this Amended Notice of Intention shall have the right to file in writing a protest against the creation of the Kanab Creek Ranchos Special Improvement District or to make any other objection relating thereto. Protests shall describe or otherwise identify the property owned by the person or persons making the protest. Protests shall be filed with the City Recorder of Kanab, Utah, at his office at 70 North Main Street, Kanab, Utah on or before 5K) p.m. on the 18th day of May, 1988. No protests will be considered lor purposes of creating the District if it is received by the City Recorder later than this protest filing deadline. Thereafter at 7:00 p.m . on Wednesday, the 1 8th day of May, 1 988, the City Council will meet in public meeting at the City Council Chambers at 70 North Main Street, Kanab, Utah, to consider all protests so filed and hear all objections relating to the proposed District. METHOD OF DETERMINING NECESSARY NUMBER OF PROTESTS 1 0 REQUIRE ABANDONMENT OF THE DISTRICT The method for determining the necessary number of protests to cause abandonment of the proposed district shall be by the number of lots included in the District as related to the number of lots represented by written protests. The Protest Rate for determining the necessary number of protests to require adandonment of the District ("Protest Rale") shall be determined by totalling the number of assessable lots of the property owners filing written protests and dividing that number by the total assessable lots witliin the proposed district.
