Answer I do not keep Kanab City files. They are all maintained by the City Recorder. I have personal files in which some of Kanab Citys documents are kept. All of these documents are only copies of public records which can be obtained from the County Recorder or State Engineers offices. I have furnished the book and page of these documents to the City Office. In some of the files which I keep relating to the legal affairs of Kanab City I have documents, evidence, and memoranda concerning Kanab Citys defense to the case which the Mayor filed against the City and three of its Councilmen for $30,000.00 damages. I am unable to appreciate the propriety of making these files available to the Mayor. Perhaps if his attoney wrould let me go through their files, we could work out an acceptable exchange of worthwhile information. Question: 4. Why have you allowed the City Council to change the City Ordinances, Section It has been changed twice and now it is left with a clouded irregularity which is not within the statutes of the State of Utah. Why has this not been made legal? Answer: It is not within my province to allow the City Council to change any ordinance. The City Council is exclusively responsible for adoption, amendment and repeal of ordinances.
