Property rezoned following public meeting R-l-- A request to rezone 91 1 acres of ROY property at 2800 W and 4800 S from RE 20 to R 1 6 has been denied by city council And at the same meeting councilmen voted to zone the property R 1 8, without prior hearing and announcement The action will be void if the city at torney rules the action is illegal Rezones must be announced properly in Subsurface water agreement postponed The public hearing was attended by approximately 30 persons, most of whom expressed disapproval of the R zone, but stated no objections to an R 1 8 zone in the area The land surrounding the area is all RE 20, which has a limit of 20,000 square foot lots with a 115 foot frontage AnR has a minimum 6,000 square feet for lots with a 60 foot frontage An R 1 8 zone has a minimum of 8 000 square foot lots The persons attending, and councilmen, agreed that the small lots would not be adequate for the housing in the area Roy presently has only one R 6 zone in the 6 Though they had promised some bdiv idei s thev would have the ordinance issed by the Julv 8 council meeting city unulmen have postponed passing a bsuifaic watei ordinance until next Roy voting In action was postponed because the attomev lias been out of town and has it pi opai ed the ordinance vet Vc have peoj le here who we told it mid lie finalized hut I guess we can t mum uted Mavoi Joseph Dawson I l 3 newspapers, giving persons interested the opportunity to attend the meeting at which the matter will be discussed Councilmen, however, voted to rezone to R 1 8, though the announcement was to discuss a rezone of R because they thought the persons interested in the property were present at the open hearing The vote was split 2 2, with Mayor Dawson breaking the tie in favor of the action Councilmen Kay Herzog and Earl Morris voted against the motion, stating they thought the hearing should be properly publicized However Councilmen Dennis Chugg and Richard Tubbs voted for the measure to expedite, if possible, developer Del Garn Smiths project without waiting for an other rezone meeting 1 city I dont think we can associate slum 8, areas with small lots, there are some very nice areas in small subdivisions But one of the most needed hings is additional room, commented Mayor Dawson, pointed out that increasing the lots from 6,000 to 8,000 square feet wouldn t be that much of a change Developer Smith indicated most of the lots were planned for around 7,000 square feet, with houses from 900 to 1,000 square feet He said the housing was planned to be in the $20,000 to $30,000 range, giving some young people that are not financially able to purchase large homes an opportunity to afford one One resident was concerned about overcrowding, with children having no where to play on such small lots Also concern was expressed about campers Doats and additional cars causing congested traffic m the area One resident said she moved to the area because it had a country atmosphere and didnt want to see that destroyed by a subdivision Smith was also informed that the citv Water Superintendent has said there isn t enough water in that area Councilman Earl Morris said adequate culinary water may not be available for about a year and a half, when Roy s secondary water system is working The R 6 zone was denied and the property rezoned R 8, with an open hearing set in case the action was illegal and the matter needs to be reannounced and another hearing held 1 1 IS? i v S fy It, t.
