But - to people in incorporated cities and towns, it aint a garbage collector. And, it wont pick up the tab for street lighting. -- The county, on the other hand, may use Class B Road funds for snow removal and road maintainahce in incorporated towns, but the road funds cant ayraentof tion and street lighting. ' - These dos and donts were made clear in a confused sort of way this week by the Salt Lake County Attorneys office and by the attorney generals office. 'Commissioner John Preston Creer, who wanted answers for the residents of several incorporated towns in the county, was informed by the attorney general that Class B Road funds may be used for snow removal ami main- - not for those other items. tainance Gerald E. Nielsen, deputy county at torney, informed Mr. Creer that in his opinion, "the county is not authorized to furnish garbage collection service to incorporated cities and towns in the county. Towns, Mr. Nielsen said, have their authority in, a state provision for making regulations to secure the general health of the town andto prevent the introduction of contagious, infectious or malignant diseases. They may prevent, abate and remove nuisances and adopt such other measures for the preservation of the public health. Mr. Nielsen explained that towns and the county have that same authority. "Being authorized to provide such services for themselves, Jhe county cannot provide these services for them. The same logic applies to street lighting. The authority, of cities and towns to provide street lighting is clear and is to be found in Utah Code under two sections. The towns faced with cost of street lighting advanced the argument that the countys acceptance of their Class B road funds obligates the county to provide for street lighting and snow clearance. The obligation arising out of the acceptance of such funds, said Mr. Nielsen, is no broader than the authorized use of such funds. Meanwhile, said Commissioner Creer, the county sheriff must provide law enforcement anywhere in the county, This but applies even in Salt Lake City with the present strength of the sheriffs department.
