An ordinance was drafted but never acted upon, City Attorney Ron Greenhalgh said. The council instructed Mrs. Perry to bill those four owners $225 for the 1981-8- 2 license, in addition to this years fee which was approved on June 29. That action is expected to be strongly supported giving bar and tavern owners the credit on this years business license. Commissioner Renee Mackay opposed the rebate with equal vehemence, Contending they have no moral or legal obligation to reimburse tavern owners, the City Council is expected to reject a request for a rebate on a Commissioner Jerry Wagstaff did not state a position although it was widely believed that he sided with Mrs. Mackay, it was noted. Joanie Perry, city business license director, told the council that all but four of the citys 19 liquor establishments had paid the fee, which the commission had increased from $50 to $300, the maximum allowed by state law. , She said the owners of the four establishments, which she would not name, had been told by a commission member (whom she also would not name) not to pay the $300 an amount the fee, only $75 member, believed to be Price, said the fee would be revised to. The fee never was changed, she noted, although Price ordered that license fee. At a hearing last week on the citys 1982 beer and liquor consumption license fees, bar and tavern owners asked the council for a $225 credit on this years license fee because of a pledge they feel they received from the former City Commission. But the council, discussing the matter at its Tuesday study session, determined that no legal commitment had been made to reimburse the money because no action was taken during a regular commission meeting. Nor did the council feel it had a moral obligation to provide the rebate since the commission was strongly divided on the subject.
