The declaration, which will be the subject of a public hearing here March 3, includes four Green Sheet area communities which could be considered for annexation to the city. The City Commission Tuesday approved a resolution setting the public hearing date. An annexation policy declaration is required by state law, City Planning Director Joe Moore stressed, and does not mean the city will attempt to annex any of the areas listed in the statement. To comply with the law in case an annexation request arises, however, the city must have drafted and adopted a policy declaration, he addk i 9 f ! t y i. k i:- Utah Department of Transportation complex and the site proposed for a large American Express operations center. The amount of traffic generated by the complex created concerns for several planners, particularly Keith Sorensen. He questioned the ability of 3600 West to handle a large influx of traffic. Architect Kevin Watts, representing the property owner, PF West, assured Sorensen that by the time the apartment complex is ready for occupancy, the west side of 3600 West will have been widened. He speculated that the apartment complexs presence would stimulate more development on the east side of 3600 West, thus assuring the widening of that side of the street also. A petition seeking to transform the unincorporated county into Lake Valley City was verified as valid yesterday (Wednesday) by the County Election Division. The petition easily contains the 100 signatures needed to place the incorporation issue on the ballot, said Kay Llewellyn of the Election Division. She said a letter of verification is being forwarded to the County Commission. But, County Commission action setting a date for the election is likely to be delayed until after the close of the State Legislature in March, an aide to the commission said. Legislation which could alter political conditions in the county and make the incorporation drive unnecessary were cited for the potential delay. A "home rule bill which would give counties more options in developing a form of government best suited to its particular conditions is being viewed as a possible solution to some of the problems. Meanwhile, the incorporation petition, pending legislation and a recent State Supreme Court ruling have brought annexation to the forefront as a political issue in the county. Lake Valley City supporters have said the incorporation effort, which they hope to see go before voters in November, 1962, is aimed r,t stopping annexations of the countys tax base until unincorporated area residents can determine what kind of government they want. Though anticipating such the status quo and hinder the orderly growth of cities, which are charged by law to provide municipal services. Lawyers for both the county and those cities say court action is almost a certainty if a lengthy delay in setting an incorporation election puts, in effect, a moratorium on all annexations. A statement within the text of a recent Supreme Court decision involving a dispute between Sweetwater Properties (at Snowbird) and the Town of Alta over the towns annexation policy declaration has added more uncertainty to the annexation question The courts ruling apparently altered the need for an annexation to be requested by a property owner, giving cities the right to annex land contiguous to its border to assure sound urban development. If Sweetwater asks the court for a rehearing on the issue, the county may request a clarification of that statement, a deputy county attorney said last week. West Valley City announced during the week that its annexation policy declaration had been drafted and set a March 3 hearing on the document. Without the policy declaration, which is required by state law, the city could not become involved in any annexation action. Nor does it have any Jr.flucr.re ovt wh it type of ma jor developments occur within a half-mil- e radius of its border, City Planning Director Joe Moore told West Valleys ruling officials Thursday. The Boundary Commission law, which includes the half-mil- e clause, indicates that major developments within that radius should annex to the city. West Valley officials Tuesday used that argument before the County Planning Commission, which approved construction of the American Express travelers cheque processof the cing center within a half-mil- e itys southeast border.
