Show PROMISES TO PROVE opening statement of haywood s at torney in which he prom ses to convince counsel for the state bo se idaho in an address that two sessions of the district court on monday clarence danow of chicago outlined to the jury the de tailed plea and defense of william D haywood to the charge that he mur dered former governor in broad description it is to be a de nial of every material count in the testimony of orchard a showing that orchard killed be cause of a private grudge borne of the loss of a rich share in the great hercules mine and explanations of the independent birc instances that tend to connect the three defend ants with orchard s life and occupy lions haywood w ill take the stan 1 to make personal denial of orchard s accusations moyer may be called to testify solely to events and circum stances affecting the western feder aaion of miners but pettibone will not be a witness in this case mr darrow explained that moyer and pet must stand trial for this same crime and declared that every law yer knew the danger whatever the circumstances of exposing men await ing trial under like circumstances mr darrow denied the existence ot the great conspiracy to murder alleged by the state with orchard s test mony as a basis denied that the fed aeration was anything but an earnest labor organization with high er wages shorter hours tolerable working conditions and the care and safety and education of its members and wives and children as its high and only motive denied the intimacy with the three defendants that orchard laid claim to denied the sev eral conference and conversations that orchard swore to denied that orchard had even committed many of the crimes he had boasted of and promised to make proof of his con tensions tent ions with many of the men named by orchard when on the stand and many witnesses of creditable charac ter not connected by any tie with the federation or its leaders mr darrow charged that agents of the mine owners association of colo rado and the pinkerton detectives as had joined hands in a con to discredit des credit and destroy the western fedei aaion of miners agents of the mine owners had he asserted committed many minor crimes to dis credit the federation and promised that the defense would show that it was a reasonable inference that they engineered the independence depot outrage as an attempt that had mis carried into a tragedy he asserted that trial was the culmination of the conspiracy to kill the organization by killing the leaders that the alon and not bill haywood was on trial and that harry orchard under the manipulation of detective mccar land was trying to kill moyer hay wood and pettibone that he might save his own life |
