A By a vote of 3 to 2 the city council last Monday night denied Arthur Daley the use of Payson crock water for the purpose of irrigating his fruit orchards on the bench south of Payson. The matter was introduced by Councilman F. C. Dixou who said that he believed Mr. Daley should be permitted to use Paysou creek his fruit trees water to preveut from dying of drouth, as at this time there is plenty of water in Pay-socreek and he did not believe that tho rights of the city would be jeopardized. Councilman Dave Shuler Mr. also declared that he believed Daley shou d be allowed the use of tho water if the right could be granted without friction. After considerable discussion, in which the matter was opposed by the mayor and some members of the council, a vote was taken. Council-meDixon and Shuler voted in favor of granting the water to Mr. Sher-me- r Daley and Councilman Coray, and Tanner voted against. In urging his contention that Mr. Daley be given the use of the water, Councilman Dixon said that if the city had a right to distribute the water of Payson creek, it had a right to turn it where it pleased.
