Specifically, at low altitudes, this is very frightening to the turkeys as you pass over. Turkeys are easily frightened by low flying objects such as airplanes, helicopters, balloons, or any other object that makes a shadow, and noise as it passes over. These sort of things often cause turkeys to panic, and all run to the corner of a barn or the corner of a turkey pen, and pile on top of each other several layers, and suffocate themselves. While not wanting to interfere with your legitimate, and lawful use of the hot air balloon, I might make a recommendation that due to the large number of turkeys in the Manti, and Ephraim area that you consider taking the balloons south out of Manti, and to the east out towards Palisade Park where any problem with turkeys would be at its minimum. To the west, south of Manti, and all through the entire area between Manti and Ephraim are several flocks of adult turkeys worth several thousands of dollars. Another possibility might be that you maintain a high enough altitude, such as three or four thousand feet, so as to not be noticeable to the turkeys. In light of this letter, I would also think that henceforth any loss or damage to turkeys caused by a low flying balloon would probably result in actionable negligence against the operator. 1 am sure that with your cooperation in this, you can maintain your operation of the hot air balloon in a reasonable manner to your enjoyment, and the publics enjoyment, and at the same time we can try to protect the thousands of dollars investment which the turkeys in the Manti, and Ephraim area represent." In response to the letter, Mr. Leisek stated that he did not want to have any contention with any local citizens, and maintained that his operation had not been hazardous to turkeys.
