Show Messenaer-Enteroris- e, Thursday. October 27. 1988 Page 6 Public hearing Tuesday airs pros, cons of new subdivision BY BRUCE JENNINGS A public on an applihearing cation for preliminary approval of a new subdivision in the area generated more heat than light during a Sanpete County Planning and Zoning Commission meeting Tuesday night at the courthouse. Indi-ano- la Ed LaVee, representing M.J. Investment Co. and the Saltzer Corp., developers of the proposed Falrvlew Ranchoes Phase III and other subdivisions In the area, presented the application for the new development. A group of property owners In the Falrvlew Ranch oe I subdivision, with Jim Noorlander the spokesman, voiced strong oppo- sition to the new development. Their opposition centered on the developer' request that they be granted access to Falrvlew Ranchoe Phase III by means of a road through Phase I. We don't want any roads going through our subdivision," Mr. Noorlander said. We want to keep our property private." The Planning and Zoning Commission finally arrived at a Solomon-likdecision: the devel e opers won preliminary approval of Falrvlew Rancheos Phase III, but were denied access to the Phase I subdivision "for any purpose." We are not opposed to a subdivision," Mr. Noorlander said, but we do want to protect our property rights. During the hearing numerous negative comments were made about subdivision conditions In the Indlanola area. Its an eyesore," a person said with respect to conditions In one development. Another complained about substandard housing, a clutter of old vehicles, dry lots. Many of the complaints centered on a lack of enforcement of subdivision requirements. If Sanpete County doesn't have the manpower to enforce the covenants, what Is going to happen when more people move In?" a woman asked. I think that the responsibility for enforcing the covenants rests with the developer and not the county," Mr. Noorlander said. The owners association has the responsibility for enforcing the covenants," Mr. La Vee re sponded. Nearly all the problems In connection with the subdivisions In the Indlanola area have occurred on developments that were established before the Sanpete County ordinance on subdivisions was enacted in 1981, explained Ross Blackham, who Is chairman of the County Planning and Zoning Commission and Is also county attorney. The Falrvlew Ranchoes Phase ni subdivision Is Intended for year round usage, Mr. LaVee said. It is bound by very rigid protective covenants. 'This subdivision will not have any of the problems associated with some of the early developments." In the meantime the County Commission has placed a moratorium on building ' i . . . i permits for mobile homes.
