Public utilities as defined by Title 54, Utah Code Annotated 1953, shall not be obligated to determine the place or places within any county or municipality where public utilities services are rendered, but the place of sale or the sales tax revenue arising from such service allocable to the city shall be as determined by the State Tax Commission pursuant to an appropriate formula and other rules and regulations to be prescribed and adopted by it. te EPHRAIM CITY ORDINANCE NO. 1998-- 6 ORDINANCE LEVYING A HIGHWAYS TAX UNDER SECTIONS AND OTHER PROVISIONS OF THE MUMCInAL GENERAL SALES TAX, THE TAX TO BE IN THE AMOUNT OF ONE OF OF OF PERCENT (14 THE GROSS SALES ON ALL SALES DESCRIBED IN CHAPTER 12 OF TITLE 59, UTAH CODE ANNOTATED 1953 AND AS PROVIDED IN THE LAWS OF 1997, CHAPTER 305 PARA. 12 (I LB. 98). PREAMBLE WHEREAS, Ephraim City (City), is a city of the third class of Sanpete County, Utah and qualifies under the provisions of the ONE-QUARTE- R 1) Municipal Highways Tax Part 10 of the Sales and Use Tax Act authorized by 11. B. 98 of the 1997 General Session of the Utah State Legislature and codified Chapter 305, para. 2 of Laws of 997 as and Sections 002, Utah Code Annotated 953, as amended to January , 998 (the Code); and WHEREAS, no voter approval is required under Section 1 1 59-12- -1 1 1 1 imposed a license fee or tax on businesses based on gross receipts prior to January' I, 1996 and pursuant to Section and 3; WHEREAS, the City requires additional revenue for maintenance and reconstruction of roads, streets, and highways within the corporate limits and boundaries of the City and such expenditures will confer a benefit upon all inhabit- ants, residents, businesses, occupations and activities within the City and the aforesaid provisions of the Code and Legislative enactments otherwise qualify the City as an eligible municipality to impose a highways sales tax; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SANPETE EPHRAIM, COUNTY, STATE OF UTAH: Section 1. Highways Tax. A. Established. . There is levied and there shall be collected and paid a tax upon all sales and uses of tangible personal property, services, meals and any and all other sales and services described in Section Utah Code Annotated within 1953, Ephraim City at the rate of (14) of one 1 Compliance With State Provisions. Except as hereinafter B. provided, and except insofar as they are inconsistent w ith the provisions ol the Sales and Use Tax Act, all provisions of Chapter 12, Title 59, Utah Code Annotated 1953, as amended, and in force and effect on the effective date of the ordinance codified in this chapter, insofar as they relate to sales taxes, and excepting Sections thereof, are adopted and made a part of this chapter as though fully set forth herein. Section 2. Use of Tax. The tax imposed and collected under this ordinance shall be used for construction and maintenance of highways, roads, streets and public ways under the jurisdiction of the City. A. Method of Collection. As provided in Section of the Code, the tax imposed by this ordinance shall be collected, disbursed and transmitted as provided in that section and administered under the conditions and provisions for collection, disbursement and distribution as provided therein. Section 3. Effective Date. This Ordinance shall take effect August 1, 1998, and upon publication of a summary as provided in 103-7- 1 1, Utah Code Annotated 1953.
