Show Imi I Mt lit III I i 1)1 tlll l (t MI4 Roy Opposes Plan To Limit Taxation ROY Tax limitation legislation currently being discussed by Utah lawmakers has brought a protest from Roy city officials who pay the city is much better qualified than the state to handle its own affairs. City Manager Richard Kirkwood told the City Council that House Bill 303 and House Bill 41 under consideration by the Utah Legislature would limit the taxing ability of cities under a static formula that would cause many problems for the city. The proposed law would force cities to hold annual budget increases to a percentage of the previous years budget based on per capita income change and population growth. If the legislature starts adopting laws to limit taxing at local level, it should also do the same with state agencies, Kirkwood said. He told the council he has spent several days testifying before legislative committees about the proposals. He presented figures which show Roy City has stayed well below the maximum budget increases outlined by the proposed legislation. The 1978-7- 9 budget year was the only year during the past six years in which the citys budget exceeded the maximum being proposed, he said. Overall, the city has saved taxpayers about $750,000 over the period according to the proposed formula, Kirkwoods charts showed. But, he said, the one year in which it exceeded the. maximum is evidence the city needs the flexibility to make ad six-ye- ar ' i justments from one year to the next. He also pointed out that the city showed a budget deficit of $326,000 in 1974-7- 5 and now is essentially out of debt and has a fund balance of $422,431 this year. "These figures show the city is a responsible governmental body, Kirkwood said. The city has taken positive actions to keep the city viable and we need the flexibility to continue to do that. Mayor Joseph Dawson said Kirkwoods report was a good indication of the citys position. The city is much, much better qualified to handle its affairs than the state is, he said. In a related discussion, Dawson said the city is sending a letter to the legislature stating the councils opposition to any taxing agency receiving a windfall in revenue from Tecent increase in property tax valuations. He said the reassessment dictated by the State Tax Commission would mean about an 85 percent increase in valuation in Weber County. He said the letter will recommend that taxing entities other than the state school fund reduce their mill levies so they will receive essentially the same amount of tax revenues they received in 1979. But if other entities take advantage of the reevaluation to get a windfall then Roy City would have to look at it, too, he said. Roy City couldnt be expected to stay the same if others dont.
