The Fifth Amendment to the Constitution prohibits the government from taking private property without compensation. The federal government has not yet decided whether to appeal the case. Responding to the decision, Congressman Chris Cannon, Chairman of the Western Caucus said, This is a clear victory for private property rights. Judge Wieses decision confirms that the 5th Amendment still stands for something. When the government takes property, it is bound to compensate the owners of that property. A public good should not be supported solely on the backs of farmers and ranchers who happen to live and work in an area where an endangered species might be found. If the public is going to benefit from ESA enforcement, then the public should pay for ESA enforcement. Its about time we recognize that the ESA does not trump the 5th amendment. Congressman Jim Gibbons of Nevada said, Its only fair-whthe government takes water from a farmer, even for the worthy cause of protecting species and habitat, the farmer deserves to be compensated for his loss.
