I sympathized, after all I am a resident of Aspen Village. I watched as frustrated residents tried to have a discus-- 1 sion with Mt. Pleasant City Council. First, I must say that I have been covering council meetings for the past few years. I .have watched the council members do great deeds for most of the residents of the city. I have watched the votes, choices and discussions take place when no other citizens were in attendance at these public meetings. But the entire city government has a "blind" spot when it comes to property owners and their rights. Property owners do not exist in a vacuum. Decisions made by property owners, especially for commercially rented out property, have a tremendous impact on all residents in a neighborhood. Residents in the area of 300 West and 300 South have cause for concern. There are three rundown mobile homes that were on a 12 acre of land. This area is zoned as single family residential. These trailers were on the property before the city had a Master Plan with zones. The trailers were then "grandfathered" onto the property.- Residents understood and accepted the decision. That was then. This is now! The property has recently been sold to Chet and Stephanie Keisel. Elswood and other residents were denied because "the agenda was full". Elswood then requested to be placed on the next agenda. May 12. On Monday, May 11, when the agenda was posted Elswood was again omitted. According to Elswood, the City Recorder said she just forgot." Elswood demanded that something be done and she reluctantly agreed to amend the agenda. The recorder chose to put the residents of 300 West and 300 South on the public participation thereby limiting them their right to speak to threfe minutes. Councilman Fortunately, Blackham allowed the residents to have their say in as much time as the residents felt was needed because they were an agenda item. Elswood also requested a copy of the citys master plan. This is a public document. Elswood was charged $25 for the copy. Elswood verified in the citys master Forever Young Such a process could mean endless red tape and discrepancy of the home for minor repairs or for allowing a friend to reside in ones home in an emergency. Many feel this a gross intrusion in private affairs. Residential are structures permitted in the Agriculture Zone provided they serve the needs of people whose "principal activity' is being in agriculture." One farmer remarked that, in todays economy, no ones principal activity can be agriculture. Farmers often take employment to support their family farm. The law could be construed to force people from living on their farms. The requirements in all zones for an 1 100 square foot minimum d for dwellings also brought protest. Many older residents live in well kept sanitary homes with less square ment discriminated on the basis of wealth or lifestyle. A planning commissioner responded that it was assumed that if people could afford land in these areas, they could afford an 1 100 square foot home. Dwellings in agricultural lands also required road frontage, approved feasibility reports, commercial electricity, proof of municipal willingness to provide services, and documentation of economic viability. The commission assured that "flexibility in the interpretation of the ordinance would assure tolerance in enforcement. But while residents desire flexibility in the use of their property, they also feared that "flexible enforce- plan that no change to the zone m which he and his elderly mother 'ive has ever taken place. Councilwoman Jarrett attempted to appease the situation claiming that the city is looking at "spot zoning" to spread the low income types of housing throughout the entire city. The residents have hired Attorney Randy Ken-narKennard believes that spot zoning under any name is illegal. I would personally like to wish the residents good luck in their effort to pursue these terrible living conditions; to help raise the quality of life for families that you dont know and cant communicate with; to help make landlords of this run down commercial property develop a heart; to find a way to keep others property values from hitting the bottom. In other words, I wish for you the same items that we unsuccessfully tried to get the city council to see in Aspen Village. d. Diane Murphy-Marti- n Mt. At one point, emotions! built as views collided. Several1 citizens invoked the Constitution, denouncing a government role in land use planning of private property. In response, others angrily recalled the horrors of land use anarchy and urged acceptance of the ordinance. Most in attendance, however, seemed somewhere in between these stands accepting a role for community planning, but expressing grave concerns about the powers of government as defined in the ordinance. Even those giving thanks to leaders expressed doubts on some matters. The proposed law states that prior to construction or alteration to any building (electrical, mewhether chanical, plumbing, municipal or alternative) or road, a permit must be obtained. In addition to permit fees and extensive paper work (including detailed site plan covering adjacent properties), a $500. deposit and signed occupancy agreement must be included in the application. A certificate of occupancy must be obtained, specifying use number of . anticipated automobiles, completion of required landscaping, etc. Any change in use or occupancy (other than "natural increase" of resident family) requires a new certificate. Violation of this process (greater density than authorized, etc) results in a public nuisance declaration subject to maximum penalties.
