Besides all other license fees that may be required of a business location or person, there is levied an annual license fee as set by resolution of the city council if such person or business enterprise makes sale of cigarettes or tobacco. B. It is unlawful to sell, give away, or otherwise dispose of tobacco in any torm in this city without first being licensed to do so by this city. No license shall be required for sales at wholesale. C. Applications for a license to sell or otherwise deal in tobacco or tobacco products shall be made in writing to the city recorder. The application shall contain the name of the applicant, the address at which such sales are to be made, and a consent to the revocation of such license in event the holder thereof shall violate any ordinance of the city or statute of the state governing the sale, gift, or other disposition or delivery of tobacco in any form to a the under of nineteen person age years. The application shall be filed in the office of the city recorder. The application shall be accompanied with the fee above required. D. No license shall be issued until the applicant files a bond with the city. The mayor and city council shall decide the form and the amount of the bond, the minimum amount of which shall be five hundred dollars. PLEASANT DOES now FIND THAT: A: The United States Surgeon General and the United States Department of Health and Human Services have found that most those Americans who die of tobacco caused diseases became addicted to nicotine in tobacco products as adolescents before the age of legal consent. B: The United States Environmental Protection Agency has classified environmental tobacco smoke as one of only twelve Class-carcinogens to which there is no safe level of exposure. C: Many scientific studies have found that tobacco smoke is a major contributor to indoor air pollution. D: Reliable scientific studies, including studies by the Surgeon General of the United States and studies commissioned and assessed by the United States Environmental Protection agency, have found that sidestream or secondhand tobacco smoke causes the death of at least 53,000 nonsmokers annually and is a leading cause of premature death and disability among nonsmokers. E: Tobacco smoking is a leading cause of fires, and cigarette and cigar burns and ash stains on merchandise and fixtures cause economic losses to businesses. F: The National Center for Disease Control has found that at least four hundred thirty four thousand (434.0001 Americans die each year from tobacco caused diseases. G: The Surgeon General of the United States has found that nicotine in tobacco products is as addictive as cocaine and heroin; required-Applicatio- n required-Applicatio- bond-issuan- bond-issuan- Accordingly, the city council of Mt. Pleasant finds and declares that the purposes of the ordinance are: To reduce the addiction to tobacco products by minors by restricting the minors access to tobacco products, and to promote the health and well being of the citizens of the City of Mt. Regulation of Manner of Sale of Tobacco Products Standard of smokeless cartons of cigarettes and tobacco are exempt from this ordinance so long as these tobacco products are under constant direct sight surveillance of a store employee. These tobacco products shall be deemed to be under constant, direct sight surveillance of an employefe only if the tobacco products themselves (and not just the displays, racks, shelves, kiosks, etc., where the products are displayed) are in plain and full view of a store employee DEFINITIONS A: "Business" means any sole proprietorship, joint venture, corporation or or other business entity formed for making purposes, including retail establishments where goods or services are sold as well as professional corporations and other entities where legal, medical, dental, engineering, architectural, or other professional services are delivered. B: "Place of Business" means any and all places such as shops, stores, factories, public garages, offices, theaters, recreation and dance halls, poolrooms, cafes, cafeterias, cabarets, restaurants, hotels, lodging houses, buses, and waiting rooms. C. "Employee" means any person who is employed by any employer in consideration for direct or indirect monetary wages or profit, and any person who volunteers his or her services for a entity. D. "Employer" means any person, partnership, corporation, including a municipal corporation, or entity, who employs the services of one or more individual persons. E. "Tobacco product" means any tobacco cigarette, cigar, pipe tobacco, smokeless tobacco, snuff, or any other form of tobacco that may be utilized for smoking, chewing, inhaling, or other manner of ingestion. F: "Minor" for the purpose of this ordinance only shall mean any individual who is less than 19 years old. G: (1) "Retailer" means a person who owns or is responsible for supervising the day to day operation of a business where tobacco products are displayed or otherwise offered for sale. (2) Merchandising" . means open display of tobacco products and point of sale tobacco promotional products to which the public has access without the intervention of an employee. (3) "Vendor assisted merchandising" means (a) The retailer restricts or ensures the restriction of access to tobacco products by placing or displaying the products in a manner so that only an employee of the business has access to the tobacco products; and (b) Customers do not have direct access to the tobacco products so that business employees must assist customers by supplying the tobacco product to the customers; and (c) Customers do not take possession of the product until it is purchased. H. Person" shall mean any individual, partnership, cooperative association, private corporation, personal representative, receiver, trustee, assignee, or any other legal entity. I. "Retail Tobacco Store" means a retail store utilized primarily for the sale of tobacco products and accessories and in which the sale of other products is merely incidental. 5.12.040 Regulating the Sale of Tobacco Products A. It shall be unlawful for any person, business, or tobacco retailer to sell, permit to be sold, or offer for sale any tobacco products by means of self service merchandising, or by any means other than vendor assisted sales. B. It is unlawful for a retailer to display tobacco products or otherwise make them available for sale through non vendor assisted merchandising methods, or by any self service merchandising method. C.
