LAYTON would be strictly enforced. Under the new ordinance, the office of inspector was created to inspect and examine property to determine if injurious or noxious weeds, garbage, refuse or unsightly objects were on the property. The location of the property in relationship to population centers would be considered in making the inspection. Priority would be given to areas which could interfere with traffic especially intersections. GREATER attention will be given to areas that have been problems in the past. The "inspector shall also consider the height of weeds; their dryness; the density, the type of weeds and their general impact considering the nuisance, health problems and fire potential." IF THERE is a violation, the inspector will find the names and owners and occupants of the property. Written notice will be served either personally or by certified mail giving the people time which shall not be less than ten days from the date of service of the notice to conform to the law. If the owner or occupant fails to conform to the law, the inspector has the power to cause such materials to be removed or destroyed at the initial expense of the city with payment by the owner or occupant. AN ITEMIZED statement of expenses is sent to the owner or occupant demanding payment in 20 days. If the money is not paid to the city, either a law suit may be instituted against the property owner or the expenses can be attached to the' - In response to citizen complaints and concern voiced by Layton s Mayor and some members of the city council, the citys weed and refuse ordinance was changed by council action at the last regular meeting of the Layton council. ALSO CHANGED was the procedure used to enforce the ordinance. In the past, enforcement of the weed ordinance has been the responsibility of the inspections department in the city. The rapid growth of Layton which means many building inspections have to be made has resulted in many weed problems going unchecked. The new policy is to have the fire department do weed inspections. The position of the city will be to answer and act on citizen complaints but not to initiate complaints by systematically searching the city for people violating the weed ordinance. CITY MANAGER, Cam Caldwell indicated he had met with Mr. Nequette, a citizen who approached the city council a month ago asking for action on weed patches in the city. Mr. Caldwell stated he had explained the steps the city would be taking in following up on weed complaints. Mr. Nequette who was in attendance at the council meeting stated he thought the new ordinance and procedures would be most satisfactory if the city officials would be strict in enforcement and not lenient by allowing citizens to use the flexibility of the ordinance to continually keep weeds on their property. -- newly-enacte- d property tax notice.
