| Show THE MORRIS CASE ellas elias morris tried on the charge of unlawful cohabitation the only mormon whose trial for an offense under the edmunds law was taken up for today to day was ellas elias morris against whom an indictment had been found charging unlawful cohabitation the defendant waived the reading of the indictment and entered a plea ot of not guilty anda jury was paneled em to hear the case it was discovered at this juncture that deputy boman cannon one of the witnesses for the prosecution was absent having gone north into the country with the intention of remaining until tomorrow to morrow even evening log mr peters stated that the deputy was a material witness in the case and that be could not proceed to trial without him film it was finally ascertained that mr live in the ward salt lake city have lived there 26 years I 1 was married to the defendant in 1852 and I 1 am still hib bib wife I 1 am willing to testify in this case I 1 live oa third west street mr morris has lived with me as his wife during the date named in tile the indictment he has another wife mary L morris morris he married her about thirty years ago she has live five chil children drea who bear the surna surname of morris the youngest is ten yours aars old mrs mary E L morris has lived at ixer her present home in the ward since 1854 or 1855 15 she went to provo between three and d four fou r years ago and remained about a year she went because the children were going to school there I 1 dont dodot know whether she consulted with mr morris cr not or who paid her expenses I 1 did not visit the children there nor did mr morris I 1 suppose he paid the lae expense morriel I 1 dont ont outpost know now whether mrs mary L morris had property of her own or not I 1 have not visited her lor for nany many years nor has she visited me it is per perhaps help 12 or 14 4 years tte the children cometo come to my Y house Ise I 1 see them ethem around everyday day I 1 think mary L owns her home we are on good terms I 1 was present when she was mairlen to mr morris he has not been to her house bouse for over four years he told me ot the arrangement they entered auw in 40 the earl early part of IM 1883 to live apart lie he has not teen been to her house since then I 1 remember being before the grand jury do not remember saying then that it was in ia 1884 my recollection is that in 1886 I 1 told the grand jury that toe arrangement was made two years or more before then I 1 considered the matter after I 1 went home then and recollected the true facts I 1 never told mr morris what I 1 said to the giand jury he be never talked to me about it mr morris gen eral brally y made his home with me folsome time belore before the arrangement was made but would KO go to see mary L occasionally casio nally perhaps two or three times a week he be changed his habits uen then I 1 think he be still supports her I 1 do not remember since he last took her out the arrangement was made before mary L went to provo I 1 expect mr morris gave mary L her home mrs mary L morris was the next witness she testified I 1 live in salt lake city on third west street have lived there 27 years have known mr Morris Morrist the be defendant defes dant since 1852 I 1 lam am not now BOW married I 1 have been married in 1852 in st louis to mr john morris he be died in 1855 1 I afterwards married his brother elias ehas in may 1856 first lived in cedar city iron county then moved to my present home where I 1 have remained aed all the time except temporary visits away I 1 went to provo in dec rober IM 1885 and returned in may 1886 to care for my soo son who was Lat attending tending the academy mrs mary 11 morris son was there as 98 was also 1110 in my little daughter I 1 went of my own volition had bad no conversation with mr morris on the subject I 1 suppose ose I 1 understood that I 1 was to care for for all the children I 1 knew his bis father sent mrs mary Es els child I 1 dont remember now how I 1 learned it but I 1 did know it his father paid board for all of us at the place we lived we boarded at mrs Loveridge ls she oad nad invited me there when I 1 went I 1 expected that I 1 would pay my board mr morris sent me money aud and I 1 used it at my discretion I 1 dont know how much I 1 received it came by mail I 1 dont know whether I 1 have the letter or not will bring it it if I 1 can find and it 1 dont know how many letters I 1 received perhaps two or three mr morris provided for me during the years 1883 and 1884 he supported me because I 1 had been married to him I 1 was his wife years ago I 1 ceased living with him as his wife about the last of December 1882 or the first of january 1883 the agreement was not made in 1884 nor in december 1883 I 1 think I 1 have told you often enough all that I 1 know about I 1 it t it was in december 1882 or january 1883 I 1 iro posea to him that he be live separate to save tim from fromang fro many any trouble he had house he may have been in my house since perhaps once or twice this was only for a few weeks it did not continue during he did not recognize me as his wife during daring 1883 1893 and 1884 it is a very gaiu ful position to me mr air morris never brings any means to roe me he never did I 1 always sent to his office I 1 used to go sometimes myself out now I 1 send the children he used to live about half the time with me to mr rawlins the boys were at provo before I 1 went there akere john moriis monis testified I 1 am the son of elias morris and mary E morris live with my parents mary L morris is my aunt she was my uncle 4 wife I 1 do not know what relation she now dow sustains to my father she lives next door I 1 suppose father supports her her sons work fr for fattier father I 1 aisup suppose she has been lathers fathers second wife I 1 do not remember when he lived with her I 1 think it is four or five years he does not go over to see her he changed his bis habit because it have been three years or more before I 1 went to provo that father and mary L separated miss sarah jones testified 1 now live in mary E morris family went there in july 1886 was never there before mr morris makes lis his home there I 1 supposed mary L morris has been mr moriis monis wife never heard mr morris or the family say anything about it have never seen mr morris at mary L s shou house sp miss nettie morris te testified stifled the defendant is my father mary E is my m mother and mary L my aunt the latter was one time my fathers plural wife but sustains no relation ten to him now he has not lived with her for four or five years court took recess till 2 p in m at the opening of the session session this afternoon mr peters announced that he had no more testimony to of ferand the case was submitted by bv both sides on the judges charge the court in the instructions to the jury said it was wafa necessary that the evidence should show that from may alay 1883 to aprils april 1886 the defendant associated with both women as his wives or a part of he time lime in order to convict the jury were out oat three quarters of an hour and returned with gifft a verdict of not guilty and brother morris was released |
