DETAILS OF THE EXECUTION in consequence of the murder of john F turner tor for the commission of which fred hopt alias tel welcome come was executed at the penitentiary today to day being one of the most celebrated cases that has ever occurred in the united State sas full particulars as are within immediate reach presented are THE MURDERED MAN fred victim john franklin turner was a native of provo city utah county I 1 and was the son of sheriff john W turner he was born january he kwas iwas a young man of good character and was not known to have a single enemy he followed the business of farmer and teamster and on the day of june 1880 left his bis horge home at provo i for park city to obtain work this was the last time his bis parents and friends saw him alive on the of july following the indy body of a murdered man was found in echo cation canon but it hwa wy not until july when sheriff sheriff turner received a dispatch stating that on ona of his sons teams had bad been sold at piedmont by an unknown man that the sheriff suspected that his bis son had met with ton fou play HISTORY OF THE CRIME john jahaf F turner arrived at park city on the ot of june he bad with him two teams and made his camp on the 9 edge of the town he spent a days day or two seeking employment during which time he met with fred hopt hop or welcome as he was then known the latter was considered a bard citizen and had several in the ens cu s j tody of sheriff turner for various offenses he had been en heard beard to state i pe that be would be r revenged on the turner family and on one occasion he said that john F turner had purchased a horse saddle and revolver tram from him and had not paid for them as he agreed to vi in telling of this occurrence he exclaimed to H S wisner at provo in reference to J F turner aby by G I 1 ILL LL KILL HIM if it is ten years irom from now BOW til III I 1 follow him to his grave nothing was thought of these threats and when hopt and young turner got together at the park the former ingratiated himself into the batters lat good graces by sonie gome means and on the he evening ot of the 3rd ard of july went to his camp there was a third party there whom the witness esat the trial believed to be jack emerson precisely what occurred at turners camp on the night of jul juis 3rd ard has never been made public emerson declared that he was there and as hopt told aitery atory ACCUSING of the crime in order to shield himself no reliance can be placed on the details one thing is certain cei tain john F turner was never seen alive after that time from all the circumstances cum stances and aad subsequent developments it is probable that after young turner had got into bed hopt took his opportunity to wreak a terrible revenge on the unsuspecting roan man there was an axe in turners wagon and this was doubtless the weapon used in the commission of the atrocious cime c ime turners s skull was crushed in on the left side ot of the head and the left jaw was broken the blood that spurted from the wound when the FATAL BLOW was given spattered hoats clothing the blow had evidently been given from behind and from an axe in the hands of a left handed person as hopt was after the murder had been committed the body was rolled up ilithe tent and A placed placed under some grain sacks in one V of t the e wagons hopt then went to a saloon in park city where he spent the remainder of the night next morning july ath hopt was met by a man named aboff who noticed blood on his shirt sleeve and bosom and on his coat when asked if he had bad been hurt hopes reply was no some s of a b has got away with his man in a dance at a hurdy house the night before a man named bates had bad a also ISO noticed the blood stains and on lits bis inq inquiring iring what had bad made them hopt said W 1 I hit a s of a b and hit bit him hard too and then choked him THE FOURTH being on sunday the holiday was celebrated in park city on monday hopt had endeavored to get emerson emersen to go along wivi with him toi mon tana aud and drive one of the two teams which he said he had but emerson would jaw BOI 0 go o alter tae me noli oay oazy he was drunk all that and the following day as when w hen he and hopt started out they took a supply of whisky along early on OB the morning of the ath of july hopt and emerson started out the rhe former driving the lead wagon in which was secreted turners body sheriff allison of summit county met them shortly after the start wae made on the road to wanship manship Wan ship at the latter place the same day hopt sold gold two sacks of chopped barley to charles reynolds but was very particular to get the empty sucks sacks back that night HOPT AND EMERSON camped in echo cation about seven miles above echo city on the evening of the ath david moore of castle rock kock was riding along in the cation when he came upon the camp hopt went out and spoke to him and offered to sell him one team but moore did not wish to buy emerson was at this time in bed hopt remained up for some hours later and the presumption is that he then REMOVED THE BODY from his wagon it was taken behind the rock into some brush and there left rolled up in the tent with rocks thrown loosely on it on the morning of the ath a start was made witti without out breakfast on the ath they reached piedmont wyoming aud and on the ath they went into a store there where they met W H moss hopt hoot who did all the business asked mr moss mess about atti getting wor work k and the latter offered him 50 per day ay for a man and team H hopt was n not at anxious to take this however and finally sold on one e of the teams horses wagon and harness complete to mr moss who paid for the outfit and received a birl OV OF SALE signed by fred H welcome and john jS emerson merson and witnessed by a justice of the peace 0 gill at hilliard a stop was made and while hopt op was as rummaging a about on in the wagon a on he e took some articles of clot eloth in inu ol 01 out an and threw them to emeron emern n sd saying ing he e ha had better wear them as they were too ago small for him they were donned by bv emerson a boy who was in the vicinity at the time being beine a witness of this incident the articles were the property of the MURDERED MAN and were upon the person of emerson at the time he gave himself up to the officers and he was brought to utah wear teanua uz them on reaching green river hopt sold the remaining Hing part of the outfit to a named hall while in green river elver he met with GPO goo P campbell and aad had several conversations with him his mind was uneasy and he be told campbell that lie he had not rested well for fer several nights he claimed to be afraid of emerson in one of these conversations he said to mr air campbell 1 I never killed a man then added hesitatingly yes I 1 have I 1 have killed a young innocent man IN COLD BLOOD from green river hopt went on eastward finally arriving at cheyenne where he was captured of which the details appear further on he had left emerson at green river and the latter having no money mondy hunted for employment and worked several days hauling grain for a sheriff in that part of the country hebben he then proceeded to carbon wyoming where he obtained employment in the coal mines the body of yng turner was found in echo cation canon seven seven mil miles eafrom from echo city by a passing teamster on the of july 1880 richard wickel j ustice justice of the peace im paneled a I 1 jury ury on the an and dafter after hearing bearing aalthe all the attainable evidence the jurors found a verdict stating that the deceased was unknown and had bad been murdered about the sheriff turner re a dispatch from echo about his bis team having been sold by a man nho ho seemed willing to let it go for any thing he could get in the meantime he had read accounts of the mysterious murder and noted well all the descriptions given putting the details together ether lie he no longer had a doubt that gis his son WAS THE VICTIM and on the he started for echo where the body bedy had been fully identified by deputy sheriff fowler sheriff turner sent to this city for a coffin and had bad the remains forwarded to and buried at he went thence to piedmont in quest u of the eat murderer or murderers t thence ence to green river and so on in the trail of ibe the fleeing fugitives recognizing his property as he went along and finally arriving at helenne Chey he yenne enns abere where he met with T jeff C carr arr a de detective active for the union pacific ol 01 ra railway ailway with whom the sheriff had P previously ly communicated by wire A f few ew minutes after his arrival he looked through the car window and saw a man whom he at once recognized as hot hopt or welcome as he was generally known at that time hopt was immediately arrested by sheriff allison and detective carr and taken joithe to the cheyenne jail for safe keeping while in custo custody y he made A PARTIAL confession f to detective carr on shewa the way y to the jail he remarked 1 I think I 1 shall swing owing for this what have you bonem done ay 11 aid ai d mr carr the apply given by sopt was to the effect that jt iv ltd killed sheriff turners sofi son the prisoner pit then went on to say that the body had been hidden near echo he said that mr turner had had him in jail for some time and had not treated him properly oberly op erly he had bad been worked without being allowed anything for it he was broke and thought it would te be a good CHANCE TO GET EVEN with the fahily and make a raise during another conversation with the detective the same afternoon hopt said he had bad not done all the work himself he be had a partner whose name was emerson and who did the killing hopt admitted that he was as guilty as if he be had bad done it aimse him himself se as he stood by and saw it done and shared in the the next day the officers started home with their prisoner on the train sheriff allison allisen talked with hopt about the crime the latter fald eaid 1 I will you yon how it came about I 1 was arrested once la in provo on a charge and I 1 got clear of that I 1 got into a little more trouble and johnny was the cause of the re arrest I 1 concluded I 1 would get pvn even with the turner family STORY OF THE KILLING was to the effect that emerson and turner had disagreed over going to montana that emerson had bad said he be would kill him and immediately went over and struck turner two blows on the head bead with a board then came ba back lone and told hopt what he ie had bad jone they then put him into the wagon covered him with grain sacks and went to the town who chere re they got some liquor they had haa been drinking considerably lor for several days prior to the murder they had then left on the morning of july ath as already narrated the prisoner was brought on to salt late lake arriving there on su sunday aday evening july 25 and was at once taken to the he city jail and placed in solitary confinement the next morning be was taken before U 8 commissioner pra 9 ewhen be waived examination and was as remanded to await the action of the grand lury jury two days after hout hoot bad been committed on july 28 sheriff turner again turned his attention to the work of hunting bunting down the guilty and he be passed through salt lake en route east in quest of jack emerson upon whose shoulders hopt had bad thrown the entire burden of the crime on the ad of august a telegram was received at this office from the sheriff dated bryan wyoming in which it was stated that the mission HAD BEEN successful and he be was then turning returning with his prisoner they arrived the same evening and emerson was at once taken to the city jail emerson had bad practically surrendered as the following dispatch which had been sent by him shows CARBON wyo july 29 1 to mr moore deputy sheriff I 1 see by the papers that I 1 am accused of murdering john 0 n turner I 1 can be found here at any time TACK JACK EMERSON the officer acted upon this telegram and found his man and arrested him without difficulty emerson E kerpon merely saying when told he was wanted all right I 1 will go with you on october I 1 1881 11 emerson was put on trial arm for compile ity in the crime on the he was found guilty by the jury and on jan he was sentenced to imprisonment for life in the utah penitentiary tent iary on march 20 1886 he was pardoned by the governor circumstances having developed pointing to the alid strong probability of his bis innocence IN THE COURTS 4 anthe of pe cember 1880 the graeca granbury gran dury I 1 ury of the third judicial district filed twenty indictments in court one of these read as follows tritt territory T rit T of utah in the third judicial district court the people of the territory of utah vs fred welcome and jack emerson murder in the first degree fred welcome and jack Er emerson nerson are ac accused 0 u aed by the grand jury of this court by this indictment of the abe crime of murder murder in the first degree committed as follows the said fred welcome and jack emerson on the of july 1880 at the county of summit in the said territory with force and arnis arms and with deadly instruments and weapons to the grand jury unknown feloniously wilfully deliberately I 1 of their malice aforethought and premeditatedly tat edly did make an assault on and upon one john F turner and with said deadly instruments and weapons did then and there feloniously wilfully delibe deliberately deliberated ratel premeditatedly and of their malice afore thought mortally wound said john dturner FT urner on at and id upon the side of his head and face from which said wound the said john F turner did then and there die and the gand grand jury aforesaid do sa say and d ch charge arge that the said frez fred welcome and jack emerson in the manner and form aforesaid feloniously felonious IV wilfully deliberately and premeditatedly and of their malice afore aforethought thou lit did kill and murder the said john V F turner iu contrary to the form of the statutes of said territory in such cases made and nd provided and YM aforesaid against are akst d the peace and dignity of the people signed JOHN 0 cunnington foreman of the grand jury H V S ottomer At tomer three days later december 17 the two men were arraigned pleaded not bilty and demanded separate trials this his demand was acceded to by the tee court fred welcome as he was named in the indictment stated that his bis true name was frederick hopt emerson gave his as john mcconnell McC oDnell the two were confined in the penitentiary without bat bail on jan they were brou erht into court and john A marshall and L J sharp were appointed by the court as counsel to defend hopt E D hoge and H F williams being appointed for emerson on the ath of february counsel for hopt moved for a continuance of the case till the next term but 4 judge adge Emer aoh who was on the ruled the motion and february xe was set as the date for THE FIRST TRIAL I 1 of this memorable case on oa the first day of the trial the attorneys for the defense renewed the motion for a postponement on the ground that important witnesses could not be secured at that term of the court judge emerson also denied this motion the case was one of intense interest to the public and the large court room was crowded almost to suffocation district attorney P T van zile and his bis assistant J H Beattie prosecuted tm the defense
