to day commencing at 10 am the president john joan T caine in the chair prayer was offered by ron hon H J grant the roll call showed a quorum present the minutes of the second days session were read fead and approved the name of J golden kimball was dropped from the committee on public institutions that gentleman not having put in an appearance at the convention C C richards moved that the freedom of the convention be extended to the governor secretary diah com judges of the supreme court and members of the bar thereof federal territorial county and municipal officers members of former constitutional conventions and representatives of the press carried W W riter kiter said that he thought it desirable that the question of minority representation should be considered and moved that the subject be assigned to some committee carried the subject was assigned to the tC committee oMmittee on ordinance and bill of rights eights the reports of ef the committees were called for and were ordered on motion of mr sharp rt referred to the committee of the whole without readi reading rg the following committees then reported ou oil ordinance and bill of rights as to all matters except distribution of powers anam bority representation on legislative department on executive department on municipal and other corporations on finance and state debt on education on militia on taxation on impeachment and removal f from roin office public public institutions the committees on judiciary on boundaries Alis cel laneous provisions Pio visions and amendments anden and en schedule and election ordinance were not ready and were granted until the next ses session siou mr hammond called the attention of the chair to the fact that the question of minority miu min erity crity representation affected the business assigned the committee on schedule and election ordinance the committee on ordinance and bill of rights was instructed to act in consonance with mr hammonds committee on the matter referred to the convention then went into committee of the whole mr booth in the chair on motion of mr sharp the com matte matt e reports were ordered read at length lor for the information of the committee of the whole the reports were as 1 follows allows by the committee on ordinance and bill of rights PREAMBLE we the people of if utah grateful to almighty god for our freedom in order to secure its bless sings insure domestic tranquility and torra form a more perfect government do establish this constitution ARTICLE I 1 BILL OF RIGHTS SEC 1 all men are possessed of e equal q ual and inalienable natural rights among which are life liberty and the pursuit of happiness 2 all free governments are founded on the authority ot of the people and instituted for their equal protection and benefit SEC 3 there shall be no union of church a and aad ad state nor shall any church dominate the state SEC 4 the right to worship god according to the dictates of conscience shall never be infringed nor shall any person be compelled to or support any form of ef worship nor shall any control of or interference with the rights of conscience be permitted any preference be given by law to any religious establishment or mode of worship no religious test or property qualification shall shah be required for any office of public trust nor for any vote at any election nor shall any person be incompetent to testify on account of religious belief SEC 5 the right of trial by jury shall remain forever inviolate but in civil actions three fourths of a jury may render a verdict SEC 6 the privilege of the writ ot of habeas corpus shall not be suspended unless when io cases of rebellion or invasion the public safety may require its suspension SEC 7 excessive ball bail shall not be required nor excessive fines imposed nor shall cruel or unusual punishments be inflicted nor shall witnesses be unreasonably detain ednor confined in any room where criminals are actually im imprisoned s boned SEC C 8 all 1 persons shall be by sufficient sureties unless tor for cap tal offenses when the proof is evident or the presumption great SEC 9 no person shall be held to answer for a capital or otherwise infamous crime unless on a presentment mentor or indictment of a grand jury except in cases arising in tile me land and naval forces or in the militia when in active service in time ot of war or public danger nor shall any person for the same offense be twice put in jeopardy nor be compelled ir IB any criminal case to be witness against himself nor be deprived of lite liberty 11 or property without due process ot of law nor shall private property be taken for public use without just j 1011 SEC 10 in all criminal prosecutions the accused shall en enjoy j oy the right to a speedy and public trial by an impartial jury of the state and district wherein the crime shall have been committed which district shall have b been een previously ascertained by law and to tie be informed of the nature and cause of tho the accusation to be confronted with the witnesses against him to have compulsory process fo for r obtaining witnesses in his favor and mohave the assistance oi of counsel for bis big defense SEC sac 11 the state shall pass no law abridging the freedom ol of speech or of the press or the right of the people peaceably to assemble and petition the government for the redress of grievances size SECT 12 the military shall be subordinate to the civil power SEC 13 no soldier shall in time of peace be quartered in any louse house without the consent of the owner nor in time of war except in thy the manner to be prescribed by law and no sta standing ar army shall 1 be kept up by the state lu in time alme 0 of P peace ace 14 representation shall be apportioned according to population SEC 15 there shall be no I 1 imprisonment for debt except in cases of fraud suc SEC 16 no bill of attainder ex post facto law or law impairing the obligations of and inheritance of property as native born citizens SEC 18 the right of the people to be secure in the their ir persons houses bouses papers and effects against unreasonable sar sc arches ches and seizures shall not be violated and no warrant shall issue but on probable cause support supported td by oath or affirmation particularly describing the place or places to oe be searched aud the person or persons od thing or things to be seized SEC 19 treason against the state shall consist only in levying war against it adhering to its enemies or giving them aid and comfort and no person shall be convicted of treason unless on the testimony of two witnesses to the same overt act or on confession in open court SEC 20 the right of citizens to areep and bear arms for common defence shall not be questioned SEC 21 the blessings of free government aaa caa only be maintained by a firm adherence to justice moderation temperence pe rence retice frugality and virtue and by frequent recurrence to fundamental principles SEC 22 this enumeration of rights shall not be construed to impair or deny others retained by the people ARTICLE I 1 11 I 1 RIGHT OP OF SUFFRAGE SEC 1 every male citizen of the united states not laboring under the disabilities named in ia tais constitution age one years over who shall baal have resided in the me state six months and in the county and voting precinct thirty days next preceding any election shall be entitled to vote for all officers that now are or hereafter may be elected by the people and upon all questions submitted to the electors at such election lection ip provided that no person who has been or way luay be convicted of treason or felony in any state or territory of the united states unless restored to civil rights shall be entitled to the privileges of an elector SEC 2 during the day on which any general election shall be held no elector shall be obliged to perform military duty except in time of war or public danger SEC 3 all elections by the people shallie sh allbe by secret ballot SEC 4 provision shall be made by law for the registration of the names of the electors within the counties of which they may be residents and for the ascertainment by roper proper proofs of the persons who shall be entitled to the right of suffrage the committee bad not completed its report on the distribution of powers and minority representation by the committee on ou legislative department part ment ARTICLE IV legislative department SEC 1 the legislative authority of this state shall be vested in a legislature which shall consist of a senate and house bouse of representatives and the sessions thereof the shall be held at the seat of govern government mient SEC 2 the sessions of the legislature shall be biennial and except at the first session thereof shall commence on the second monday in january next ensuing the election of members of the house of representatives unless the governor shall convene the legislature by proclamation SEC 3 the members of the house of representatives shalar shall except at the first election be chosen biennially by he qualified electors of their res respective ec t districts on the first mond monday in august and their term of office shall all be two years from the day next after their election SEC 4 the senators shall be chosen by the qualified electors of their respective spec tive districts at the same time lime nd and places as 99 the mem members beris of the house of representatives ard their term of office shall be four years from the day next after their elec ton ion except as herein othe otherwise provided SEC 5 3 the first legislature shall consist of thirteen senators and awen ty six representatives the number of senators and representatives may be increased but the senators shall uever weed exceed thirty in number and we the number of representatives shall never be less than twice that of the senators the apportionment and increase of the members of both houses shall be as prescribed by law SEC G no person shall be a senator who snail not have attained the age of twenty five years nor shall any person be a senator or representative who shall not be a citizen of the united states stales and who except at the first e lection election shall not have been two years a resident of this tais state and lor for one year ear next preceding his bia election a resident not of the district in which he is elected no person holding any state office except officers of the state militia commissioners of deeds and notaries not aries public and no executive or judicial officer shall have a seat in the legislature SEC 7 the members of the legislature shall before entering upon their official duties take an oath nath or affirmation to support the constitution of tile the united states and of this state and faithful faithfully iv to discharge the duties of their respective offices SEC 8 each house shall judge of the qualifications elections and returns of its own members may punish them for disorderly conduct and with the concurrence of two thirds of its whole Buna r expel a member suc SEC 9 no member of the legislature shall during the term for which he shall have been elected be appointed to any civil office of profit under this state stale which shall have been created or tile the emoluments of which shall have been increased creased during during such terme term except capt such office as may ae filled by election by the people ajic siclo 10 members of the legislature in all cases cages except treason felony or breach of the peace shall be privileged from arrest during the session of tile the legislature and for fifteen days next before trie the commencement and after the termination thereof and for any speech or debate in either house they shall not be questioned in any other place S z c 11 when a vacancy occurs in either house the governor shall order an election to fill such vacancy 12 A majority of all the members elected to each house shall constitute a quorum to transact such business but a smaller number may adjourn from day today to day and compel the attendance of absent members in such man mann nr n r and rand under such penalties as each house may presence IS 13 each house shall establish its own ruiea keep a journal of its own proceedings and publish them except such par pans 18 as require secrecy and the yeas and nays of the members of either house on any qu question estloa shall at the desire ol of any three members present be entered on the journal SEC 14 the door of each house shall be kept open dubiner its session except the senate while sitting hitting in executive seshion ses biou and neither house shall with out the consent of the other sojourn adjourn for or more than nur nar to any other place than that in which it may be holding session seya ses ioa sec BEC 15 the enacting clause of every law snail be as follows be it enacted d by the legislature of the state of 11 16 any bill or joint resolution may originate in either house of the legislature and shall be read three times in each house before the final passage thereof and shall not become a law without the concurrence of a majority of all the members elected to each house on the final passage of all bills the vote shall be by yeas and nays which shall be entered on en the journal SEC 17 no law shall be revised or amended amen led by refe reference Lence to its title but the act as ft or section as amended shall be enacted and published at length SEC 18 all bills or joint resolutions passed by the legislature shall be signed by the presiding officers of the respective houses sac 18 the legislature shall not grant rant any special privilege or billot bill of divorce nor authorize any aay lottery gift enterprise or game of chance SEC 20 no money shall be drawn from the treasury except as appropriated by law SEC 21 provision shall be made by law for bringing ingine br suit against the state SEC 22 the first arst regular session of the legislature may extend to one hundred and twenty days but no subsequent su abse regular session shall exceed sixty days nor shall any session convened by the governor Ko vernor exceed twenty days SEC 23 the members and officers of the legislature shall receive for their services a compensation to be fixed by law and no increase of such compensation p pensa ensa tion shall take effect during the term te r for which bi h the members and officers of either house shall have been elected SEC sac 24 every bill passed by the legislature shall be presented to t the governor if he approve it he shall sign it whereupon it shall become a law but it if not he shall return it with his objections to the house in which it originated which house shall cause such objections to be entered upon apon its journal and proceed to reconsider it if after such consideration it again pass both houses by a vote of two thirds of the members elected to each bouse it abah become a laws law standing the governors objections if any bill shall not be returned within live five days after it shall have been pro pre stated
