at the news office he returned on oct 20 from a mission to the southern states on which he started on dec 7 1896 1895 his labors were in the mississippi conference and he was kindly received by the people peo ale and met with good success as a missionary he reports the work there as progressing s quite favorably and with bright prospects elder openshaw was released a short time earlier than is the usual rule owing to sickness in his family two of his children died during his absence the last one of these being a victim to typhoid fever and being buried one week before he reached home sister openshaw is now severely III but it is hoped that she will speedily recover elder john H akert of the fifth ward this city called on the news this morning and reported his return from the swiss and german mission field for which part of the world he left this city oct 12 1895 elder akert spent most of his time in traveling throughout switzerland where he preached the gospel to many honest souls and succeeded in opening up the way for abood a good work in the future the people treated him well and all in all he enjoyed his labors very much and returns home in good health well pleased with the privilege he has had elder william H linck who left this city in company with elder akert has been released and will be home about thanksgiving meanwhile he Is visiting relatives and friends in germany the jury in the T thomas ho mas murder trial came into court shortly after 2 this afternoon with a verdict of not guilty judge norrell immediately ordered the defendants discharge and in a few minutes mrs thomas was surrounded by a hundred or more colored people who congratulated her on her liberation the jury came to a 8 Ae decision cislon oaf on the farst ballot and in less than fifteen minutes after they had retired ti red to their rooms they were then taken to lunch and on their return lent ent word to judge norrell that they had agreed upon a verdict the result occasioned no directors of the utah sugar factory held a meeting today and declared a dividend of 5 per cent and con considered the question of the price to be paid for sugar beets for the ensuing year it was decided to fix the price at per ton delivered at the factory as against 4 the price which prevailed last year this increase is based upon the fact that the tariff act recently passed advanced the price of sugar on the general market 1 per hundred pounds the beet crop unfortunately is very small as compared with that of I 1 last ast year being only about half of that harvested in 1896 sarah IEL died at her home in forest dale yesterday afternoon at 3 she was born on the day of june A D 1838 in franklin county pennsylvania and came to utah in 1862 resided in salt lake city until 1866 and then lohowa we are receipt of your cation of the dinst in reference to one who is confined in the state insane asylum at provo from the facts shown in your communication and in closures it appears that the person Is under an indictment tor for the crime of murder however before being placed upon trial under the indictment there was an inquiry as to his sanity at that time as provided in sections et seq of the code of civil procedure which resulted in a finding at that time that he was insane and he was therefore committed to the asylum section provides for the trial of at such person when he becomes sane th there e is however in this act no definite formby form f procedure for removing him from the custody of the officers of 0 the asylum into the custody of 0 the sheriff of the county where the crime was committed 1 I find however that the legislature of 1896 in chapter section 31 being an act in reference to the state insane asylum provides for the discharge charge of a person from the asylum when they have become sane 1 I would advise you that under the said section some person should file an affidavit with the board of insane asylum commissioners setting up that persons sanity and that the person is unjustly deprived of his liberty the board should thereupon request the judge of utah county to inquire into the sanity of the person and if upon examination the person should be adjudged not insane then an order should be made discharging him from the custody of the superintendent of the asylum but remanding him to the custody of the sheriff of salt lake county to be placed upon his trial for the crime charged in the indictment it would also be advisable to make a showing in the jhb affidavit and also at the time of the hearing before the judge that the person is under she was attacked with a spell of coughing and an hour later expired at the time of the attack she was passing the residence of mrs alice greenwell near the corner of twenty fourth and monroe avenue and she was taken into the house dr dickson was called though he worked for some time with her it was of no avail dr dickson stated that the cause of death was heart failure mrs meyers was the wife of ambrose meyers and lived at 2321 2821 quincy avenue she was 49 years old and leaves four children two boys and two girls to mourn her loss lose she has been subject to severe attacks of coughing and only last sunday had a very severe one and had frequently complained of a pain in the region of the heart at an early hour this morning mr B U P F cummings sr who is nearly 77 years yeara of age was points out of his eye since that time the gentleman has not suffered any pain mrs cazier received the unstinted thanks of the gentleman for having afforded him the desired relief A brief telegram from elder ellas elias S kimball president of the southern states mission to president woodruff announces the death yesterday sunday october 1897 from typhoid fever of elder lewis jacob bushman the telegram was sent from chata the misson headquarters but conveys no particulars beyond those given the state and county in which elder bushman has been laboring Is not even given reference to the church records here shows that he was born at lehl lehi utah july 16 1872 and that he is the son of martin 13 and lucinda I 1 L goodwin bushman he left home for his misson april 15 1897 and held the priesthood of a seventy to which calling he was ordained by president C D Fj elstead at the time he was set apart it is thought that he Is a married man payson globe hugh wilson for many years a resident of this city died at his home tuesday at noon of la grippe he went home the friday before he died and complained of being sick and went to bed and never got up again he was an honest industrious hard working man and it is said that a hundred wells in this city are the result of his labor deceased was born in england jan 1 1838 and when a boy he left home and went to sea where he
