Show The Magna Times, July 9, 1 981 , Page 7 I The Beat of a ifferent Drum Part 3 Hope and Tragedy Mix on 5400 South in Kearns by Jackia Parkins Thayna KEARNS In a last effort to help solve the of Kearns problem residents on 5400 South, As I grow Older I seem to become more and more aware of the fact that the victims of crimes are often treated like criminals while the real of crime get off easy. Lets start off easy. Take the fellow who ran into four pieces of property and did extensive damage. His mothers car was totaled and his insurance has lapsed. He owns nothing and has no real means of rs . Jackie called Thayne forces, the two medias, and I think we are starting to get results now. KSL tells me that they will try to continue working with me until this problem is resolved. she smiled. television news to ask for assistance. I explained aQ that the The problem now seems residents had done, the PTA and the MAGNA to be a fight between the TIMES and asked for county and state since both are involved. The state assistance. she said. KSL had been here two owns the land and the times and shot over two county maintains it, but the hours of film, interviews state is the one who places concerned citizens and all the road signs and sets contacted state and county the limits of speed. Sheriff officials. We have joined Hayward seems to have to K.S.L. support. That means that the four victims, property owners must file a claim with their homeowners insurance and pay the $100 deductable. The victims must prove the damages over and over again, spend time getting bids for work to be done for repairs, and unless their name is Rockafeller they must do without to get property back to normal. Under the law, if the mans insurance was in affect, the victims would not be paid for time spent on police reports, filing claims, loss of work, and inconvience. The one who caused the crime just sits back and says so v. hat. What about a rape victim? In the event of prosecution she must have her past brought out, very personal past, in a trial while the rapist has a right to privacy of his or her part. The victims manner of dress is talked about at the trial, etc. etc. It is often the victim that is standing trial while the rapist goes free. How about a person who has property that is repeatly damaged and catches someone running from the scene of the crime? The police ask, did you see him do it?. Now, you can say in all honesty you did not, but the house is all ablaze, the man climbed a five foot fence to enter your yard in the first place, but since you did not see him light the match he goes free. He also knows he can continue to torment you as long as he isn't caught in the act. If a man comes into your home and you shoot him on your property and you dont kill him, he can take you to court. I heard a police officer talk about this on the radio one night. So what do you do, wait to be shot or robbed first? In the television movie (based on a real case) , ' A Case of Rape, a lawyer said that he would not defend a rape victim unless she was a nun with three stab wounds. I know one person who is a victim of a family member who is an adult. This person is addicted to drugs, is often drunk and off his rocker (so says the family victim) . The police will not hel p the victim. The victim has been beaten, threatened and forced to leave the home. The police cannot arrest the perpatrator, it is a domestic matter. I wonder why the rights of the accused are not as equal to that of the victim? It they were, perhaps justice would be served. I have spent this week interviewing victims of crimes and I spent three hours listening to a radio program interviewing other victims who are seeking justice. I beg to be proven wrong in my belief that the victims continue to be victims while the accused get off the hook. work with one arm tied chicken or the egg? added behind his back.
