they ie ic late to county school districts of the first class as herein described be it enacted by the legislature of the state of utah SECTION 1 COUNTY SCHOOL DISTRICTS OF THE FIRST CLASS ill each count corint of this state stale where a school listii ct therein the limits of cities of the first class arid and second classes shall comprise a school population of more than three thousand children over six arid and under tinder eighteen years ears of ago age as shall appear tom ion the last enumeration reported to co the office of the county eident of schools or ot of the state su as the case may he be said ni strict of more than three thousand hool population shall be known as ii county school district of the first aass lass said county school district of lie first class is hereby placed upon rue same basis as school districts in aties of the second class under the he aws of this state except as herein otherwise provided and the public school SN system stern therein shall be controlled by the board of education of such district the name of such distinct shall be as designated by resolution of the board of county commissioners in tile the county where such sach district is located SECTION 2 SCHOOLS THEREIN TO BE FREE UNDER DIRECTION OF BOARD in each district subject to the provisions pio visions of 0 this chapter the public schools therein shall lie be tree free to 0 o all children between thet the ages aes of six schools rb and school property therein shall be under the direction aud and con rol of the board of education SECTION 3 BOARD HOW CON the board of education 1 each county school district of the ti st A class shall consist of five mem giors one to be elected from and by irli it of fl ive five representative precincts othin said school district where ay iy y such district Is divided into a fiser eser or greater number than five 4 i at the time of coming under die lie operation of this chapter then rhe emaid of county commissioners oil in which such district is located shall forthwith divide the same into depre precincts for school purposes but where any such school district that now exists or may be created hereafter is divided into five precincts tor for the election of justices ot of the peace arid and constables such precincts are hereby constituted school representative precincts the boundaries thereof to remain such until change J according to the law provid ing for changing the boundaries of precincts in counties I 1 SECTION 4 M MEMBERS E M D E R S or OF BOARD boand HOW ELECTED HI BI U S T QUALIFY there shall be elected in ill ia the county school districts of the first class on the he first wednesday of december nineteen hundred and five one member of the board from each school representative precinct for a term of three years and in nineteen hundred and eight and every tour four 1 bears ears thereafter on the first wednesday in december one member front from each school le ie precinct for tile the term or of tour four years where any count county A school distinct of the first class exists or may lie be created the board ot of county commissioner shall appoint the members of the board of education to serve until he file next election provided for in this section and until their successors are duly elected and qualified provided that where there have been designated three trustees for the entire district each one being biorn a school representative senta tive precinct then these are constituted members of tile the board of education Idu catlon until the next election arid and the board of county commissioners shall appoint two other members one from pach each representative senta tive tire precinct but where two or more trustees are from one ofie school le precinct the board of county of afflec and bonds to be filed with the county clerk cleric SECTION I 1 13 CO compensation 11 10 nr or OP BOARD tho the members of oe the board of E education du cation shall fix the compensation c pensa tion to be received for their services at a su sum m not to exceed three hundred bundred dollars per annum and traveling expenses not to exceed fit fifty ty dollars per annum provided that the compensation of the members of the board appointed prior to any election of members as named ile herein ircia shall be fixed by the board ot of county commissioners ners 0 a SECTION 13 15 APPORTION apportionment INIE IT OP OF SC SCHOOL HOOL MONEYS the enumeration 6 lists shall be filed with the cleric of ortho abe board beard as soon as coll completed I 1 and not later than the tenth day of august immediately there after the clerk cleric of the board malce make out and forward to the county superintendent it if there be one to the county auditor and to the state su superintendent p erin a statement showing the number of children of school age residing in the district together with all information oata obtained ined under the provisions of the last preceding section and financial and statistical reports for the past school year containing such items as shall be required by law or by the state superintendent and thereupon the state superintendent shall allot to such school district a proper pro rata ol of state school funds subject to allotment and shall apportion the amount due and certify the same to the board of education of said district the state superintendent shall also make jo to county school districts of the first class the apportionment required by section seventeen hundred and seventy five revised statutes of utah 18 as and furnish to the county treasurer the county auditor and the county su superintendent pert nt it there there be one in counties where any such county school district of the first class may be situated an abstract of such apportionment as in the case of cities of the second class the auditor of counties divided into districts of the first class shall apportion to the several school districts in his county according to the number of school children residing in each district over six and under eighteen years of age is as shall appear from the last anum aeration from his office and shall no tiry tie cie board of education of each district of the same SECTION 21 POWERS OF TUG THE noard DOARD the board of education shall have the power and authority to purchase and sell school house sites and improvements thereon to construct and erect school buildings and to furnish the sa same ne to establish locate and maintain kindergarten schools common schools consisting 0 of primary and grammar grades high sch schools cols and industrial or manual training schools to establish est ablith and support school libraries to purchase e exchange x repair and improve the high school apparatus p D aratus books furniture fixtures and all other school supplies in said schools it shall supply and loan pupils in the r several everal grades and departments ol of said schools except ex ept the high schools school diee of charge all text books ind and supplies used by y the pupils of said sell school ool it shall have the power to sell to pupils in the several grades and departments of said schools at cost all text books and supplies used by the pupils of tile the said schools to collect all books and apparatus loaned to the pupils of the public schools of 0 any such school district of the first class or damages for the loss injury or destruction of the same to assign to the state normal school for tile the purpose of illustrating instruction in the practice school connected therewith a sufficient number of pupils of appropriate grade and reimburse tile the state university or state normal school for the instruction of such pupils at rates per pupil not exceeding the average cost of instruction per pupil in the public schools of the district as ascertained certa ined for each year to do all things needful for the maintenance prosperity and success of the schools anti and the promotion ot of education to adopt bylaws by laws and rules for the procedure of the board of education and make and enforce all needful rules and regulations tor for tile the control anti and management of the public schools of
