taxes on the ground that property was the city committee on claims levi axtel deputy abter reported that one horse was not net sufficient for his use and asked that 15 per month be allowed him for extra horse feed committee on irrigation lavid david john petitioned for a lease of the sand and gravel beds committee on public grounds john E billings reported that there was due him for a horse taken up and sold by the keeper of the pound while he was absent from the city committee on claims D A nelson asked for a transfer ol oi license to C M peterson committee on license 0 W higgins and of a franchise for fora a broad gauge railroad track to the salt lake los lios angeles railway company on south temple street streel committee on streets E A anderson protested Dro tested against a the extension of the franchises of the salt lake city gas COM company PaDy or the salt lake power light and heating company to ti ft a salt lake and ogden gas and electric light company ou on the grounds that he be owned stock in ID both compa leg lee and koew know nothing of an assignment to the salt lakeland lake and ogden company as claimed in the resolution asked for at the last meeting laid over to come up under the head of miscellaneous business the mayor announced the appointment of J M W garey and john humple as policemen and askel that his bis action be confirmed committee on police the superintendent of waterworks water works sent in a communication with refer enoe ence to the need of a new wagon la in his department which will cost 80 committee on water works TWELFTH EAST STREET GRADE the city engineer reported the the cost of bringing the intersection of second south and twelfth east streets ito to the permanent grade the estimate was as follows second south council for agreement as to details to be considered in friday evening adopted the committee on improvements reported favorably upon the petition of certain parties for an electric light at the intersection of north and third streets and twelfth east and south temple streets adopted the committee on improvements reported favorably upon the petition for an aim electric light on first south friday evening ext at the city council hold held an adjourned session last laet night it was 8 when the president gavel gave fell and the recorder ordered to call the roll the members present were rich karrick hardy horn bell lawson kelly evans evane beardsley Bear daley heise folland moran 14 absent none the proceed inns the committee on streets reported favorably upon the extension of the franchise of the salt lake and ogden gas and electric light company A lengthy discussion then ensued as aa to whether or not the ordinance sub emitted in connection with the report had bad been read in full or by title at a previous meeting folland said he be did not understand why so much haste baste was manifest in the passage of the ordinance di nance nanee it was an important measure and should be given careful consideration when members pressed the passage of a measure as they were endeavoring to do in this instance even before the ink with which it had been written had time to get cold it looked a little suspicious auspicious besides there was other business which should be disposed of petitions had been prevented presented to the council three or four months ago aeo and they were constantly ignored business should be transacted in a businesslike manner everything should come up in its turn horn called mr folland to order saying petitions had not been ignored as insinuated folland retaliated spiritedly by saying that wendell benson fully four months ago had asked for a gas franchise and pro ferre I 1 to furni furnish sti gas at per 1000 cubic feet and that mr horn was well aware of it the president rapped order after which the ordinance was read the first time and by reason of certain inter po lations lons having been made further action was postponed until one week from tuesday next assessments CONFIRMED an ordinance was waa passed confirming the assessments on the land and lots iota on first south street between east temple and state street from the west line of state street to the east line of east temple street and on both sides of first south street between eighth east and twelfth east streets from the east line of eighth est east street to the west line of twelfth east street all in sidewalk district no 2 for the purpose of if paying paving the sidewalks on said first sonth donth street an ordinance ordina ace confirming the assessment ses seso ment upon the land and lots on both sides bides of second south street bei be tween east temple and west temple streets in district no 8 from the east line of west temple to the west line of fast east temple street for the paving on OB sidewalks aide walks on said bald second south street was taken up and read the first time it was then read a second and third time and passed an ordinance confirming the assessment on lots lota in district no 4 for paving sidewalks on second south street between eighth and twelfth fast streets was wan read three times and passed an ordinance confirming the assess went ment on lots lota in district no 17 for the paving of sidewalks on south temple street between J and S streets was read three times and passed TO PROVIDE FOR FOB PAVING moran offered the following which was adopted resolved that the salt lake gab electric light telephone and telegraph companies the superintendents ts of water works and be notified by the city recorder to take such action in their respective spec tive capacities as will insure against delay in the work of paving on main west temple first south and second south streets which will soon be started also that thac the board of health be r requested to notify property owners within the same district and who have failed to put in the necessary connections to attend to the work at once sanitarium FRANCHISE an ordinance granting to harvey M bacon bacca and his successors and assigns a franchise to lay water pipes uncertain in certain streets of the city was read three times it grants to mr bacon his successors successor and signs assigns a franchise for the purpose durpos of erecting and maintaining a bathing resort or sanitarium or both in this city where the hot mineral waters of the springs in or near the north part of the city may be used the right to lay and maintain water pipe or pipes to conduct such waters along the following mentioned ot streets avenues roads and aile alleys 8 in said city to wit the alleys in the arm warm springs subdivision sub division cement avenue lime avenue agate street topaz street gem street county or state road second west street and on third south street into the property now known as the palace stables on said third south street such pipe or pipes to be laid at such place or places in said streets and avenues roads and alleys alley as the city engi engineer noe may indicate and under the supervision of the supervisor of streets there to is also granted to said grantee his successors and assigns the right to lay and maintain a discharge pipe or pipes from the building or buildings to be used as such bath resort or sanitarium to the public sewer on third south street and to discharge the waters of said bath resort or sanitarium in said sewer under the supervision and direction of the superintendent perin of sewers the franchise shall continue for a period of twenty five years from the date of the passage of the ordinance the city shall in no way be liable or responsible for any accident or damage that may occur by reason of such pipes or the laying or maintaining of the same or by leakage or from an any y sediment precipitation or injury that may be caus d by such waters to the sewer pipes of the city and said grantee hl his successors mes sors and assigns agree to save thu the city from all 11 liability loss co oost expense or damage arising by reason of r raid aid pipes or the water conveyed thereby or the maintaining of the same I 1 and to indemnify and repay said city for any loss oss cost coat expense e or damage of any kind which may axlen be sustained stained by reason ot of such pipes or water and if any judgment lor for damages or tor for any loss lose or in ury shall be recovered the oily city by reason of f ucb pipes or water the recovery thereof and the judgment shall be final a as s beaw between e on the city and said grantee his bis successors and assigns and conclusive as to the liability of the latter to the former provided the then holder of this franchise have timely notice of such suit and opportunity to defend the same the measure was discussed pro and con until midnight when the bolous wearied from debate adjourned and wended bended their way homeward |
