Show THE GILMOR SHOOTING CASE in the continuation of the gilmor case on saturday a dec dr benedict was recalled and testified that he had examined the wound of dece deceased asad carefully and that the shot had entered in a direct line the person shot must have stood erect when the shot was tired fired and directly fact facing the person who did the shooting na he e stated that he had removed the clothing from but saw no wounds on the armor arm or other parts of the body except the central wound it would have been impossible for a person st at hiding in the position described by the gilmor to have been shot in the way was if lie had had bad his rifle to his shoulder as claimed some of the shot must have struck his arm but it did not if he had been in the act a t of preparing to shoot he must have been in a position for some of the shots which entered his body to go TO in a slanting direction but all of them went straight in his breast must have been fully and squarely square ly exposed to the shot a thing which could not be if he was in the act of raising a gun to his shoulder dr dart was the next witness called by the prosecution he stated that he was familiar witt with firearms and thought that a ball fired yards from a rifle and striking the ground so as to plow a furrow between two and three feet would necessarily be much battered A ball claimed to have been found at the gilmor ranch by gilmers Gil mors boy on the day of shooting was examined he thought the ball should be more battered for being fired the distance stated dr benedict was called to exam ine the bullet if a bullet is fired SW yards he thought it would necessarily have to be chang edmore more mr spencer a dealer in firearms testified A bullet is usually much out of shape after being fired yards and striking the ground so as to plow a furrow three feet long he thought the bullet looked as if it were of a defective mould if the bullet be defective it would not be likely to go so swiftly from the rifle M R evans testified to having shot a rifle a good deal he thought the same as the other witnesses that a ball fired yards would be mud much i disfigured examined the bullet and thought it could hardly have been fired that distance to colonel kaighn it may not be wholly impossible for it not to have been more flattened but in my judgment it should have been more so braon orson demott testified I 1 saw joseph one day with gilmor one day at my fathers father shee sheep P camp never saw raise mise his gun heard gilmor do some great coming ordered him off the ground he had bad his rifle hung up in id its case in the cabin did not have it in his hands at all gilmor waa there when gilmor left he had it in his hand but laid it on the bed never saw him point it at gilmor mr gilmor came to tell W some of his sheep were on bis land took the gun down to kill a sheep never heard say he would shoot the head off of gilmor or anything of that kind the boy said he was in bed when gilmor came to thecae the camp a p saw him go west when he be ae left f t had bad only talked to his papa once about the matter shortly after it happened all this happened about a month ago the pros cution rested this was ob objected acted to by the defendants counsel se who claimed that several witnesses had been subpoenaed and had not been placed on the stand commissioner Ure greenman enman thought he bad no right to say that the prosecution should place witnesses on the stand when they wished to rest the me case defendants still further demanded that such witnesses be placed on the stand mr morse said the case was virtually not in his hands but he was conducting it for the prosecuting attorney judge mckay being sent for said he had concluded not to put the officers who visited gilmers Gilmor Gil mors ls ranch on the stand he had bad no hesitancy in stating why he did not do so the defendant hamtak had taken n out these officers for his own now if he wanted them placed on the stand he be could do it for defense to ask prosecution to place them on was absurd the commissioner again ruled that he had no power to force the prosecution to place witnesses on the stand deputy springer was then called by the defense he testified to having gone to gilmers Gil mors ranch last monday on request of deputy united states marshal vandercook he found a dead man lying on the ground and near by was a repeating rifle full cocked it was found to have one cartridge in the chamber about fifty rods southwest of the body he found a mark in the soil made by a bullet which mark was about two feet long and about three inches deep A little boy of gilmora was with him and he picked the bullet up about eight feet further on the ball was covered with black earth did not serve any subpoenas while out there as he had left the at home but told the witnesses to come the day was disagreeable and the soil muddy when they visited the place to M morse I 1 got out at the place about noon never touched the body when the boy found the bullet I 1 never saw him pick it up but saw him in the act of raising up deputy franks was next called by the defense he testified to having visited gilmers Gil mors ranch much under instructions from deputy marshal vandercook found lying about fifty yards west of gilmers Gil mors house with a rifle lying near the body did not think that anybody had touched the body found the gun cocked and one cartridge in it round found tracks of deceased going boiu east nearly in the direction of the house ouse to mr morse mom 1 I was waa not present when the bullet was found by oil gil little boy but saw it shortly afterwards it was then covered with black loam an adjournment was taken till december when the defense called stephen hansen he testified I 1 heard filp alv shots fired that day when I 1 heard the first shot I 1 could not see any one then there was a lapse of about 15 minutes and another shot about 15 minutes after this a third lot shot was fired and I 1 saw a man whom I 1 think was about yards from where gilmor was driving the sheep the smoke was near 10 minutes latter there were two shots close to gather and I 1 saw smoke near gilmor I 1 then went home and heard of being killed I 1 did not go over to the scene of the tragedy several other witnesses were examined but nothing new was elicited after the arguments commissioner green took
