habe corpus he stated that there were two points of difference from the barton ewe case these being that bishop maughn has served a term for unlawful cohabitation and that the alleged sill eged adultery was within th the e period in the unlawful cohabitation charge mr richards said he would like to know from the court if the decision in the barton case would reach as far as the circumstances cum stances of the maughn case judge judd inquired do you say mr richards that he be has been punished for tin unlawful lawful cohabitation mr richards he was sentenced on dec 3 1888 and has served a six fix months term and paid the fine and abid costs judge judd and the adultery was within the time covered by the other charge mr richards the unlawful cohabitation was from January to nov 28 and the adultery with the plural wife is alleged on october 1 1887 the record shows that the court consulted for 61 a few minutes and judge judd said what have you to say brother hiles mr hiles the record does not show abow that the defendant pleaded a former conviction judge zane you yot mean the record in this particular case mr hiles yes the record mr richards the record shows as I 1 have stated the applicant has been punished for the time when this offense was alleged to have been committed mr hiles counsel knows very well that the decision in the barton case fully covers the maughn case there months on a charge 0 of unlawful cohabitation theodore dedrickson of spanish fork was liberated from the penitentiary tent iary on june 14 he had served a sentence of sixty five days for unlawful cohabitation and an additional month for nonpayment non payment of the costs preston lewis of big cottonwood was litie liberated rated from the peni on june 15 after serving a term of days for unlawful cohabitation U he was detained for 30 days longer for nonpayment non payment of finland fine and costs which amounted to david A sanderson Sander farmington also left the pen 1 I that day on the expiration of his sentence of days the fine th in his case was for which he served out an additional 80 days wm ball and wm gurney of lehi lebi and anthony heiner of morgan city were also released jesus christ of latter day saints upon consideration of the matter of renting the church farm now in the hands of the receiver it is the orde the court that he advertise for bids for seven days in the salt lake newspapers ra said bids to close on june and the farm will be rented to the highest responsible bidder said renting minting will run to april 1890 subject to termination november ast 1st 1889 by the order of this court A report will be made by the re receiver celver to this court at 2 on saturday june 22 it will be remembered by our readers that the farm was let afew a few days ago to biennial nial election of the officers of the deseret telegraph company in february last receiver V F EL dyer addressed the following communication muni cation to the territorial supreme court to the Kono honorable rable supreme court tn in addition to my regular monthly report I 1 desire to direct the especial attention of the court to the fact that I 1 hold as receiver of the church of jesus christ of latter day saints sainte shares of the capital stock of the deseret telegraph company and that there are about sixty eight shares held by individuals the election of officers occurred some sometime time previous to the turning over of this stock to me and I 1 am informed that the annual election of officers will take place on the of next june I 1 desire to state to the court that in view of the fact I 1 hold this stock as receiver and am not authorized to transfer any part of it for the purpose of electing i such directors as I 1 may see fit fitl am placed in an awkward position as I 1 cannot transfer any of the stock to the persons person 8 whom I 1 might see fit to elect as directors while I 1 hold 1 nearly all the stock and can vote it and of bourse could elect whomsoever transacted by the deseret Desere fc telegraph company for the years ending december 31 1885 86 8 88 78 which I 1 have just obtained from mr W B dougall the manager of said company all of which is action that morning but it did not the stockholders ti meeting was held but no election took place the receiver holds the majority of the stock which was seized with other church property and if he had voted it could have elected a board of officers from among the stockholders but this would have left the control of the company in the hands of the actual owners of the property but the receiver as aa shown by his communication to the court wants a board aboard of his on o n making thesis this is not possible unless the court orders the stock transferred to those who have no title to it whatever the stockholders object to this proceeding as in the event of the stock being returned to its proper owners by the supreme court of the united states there would be elected for two years a set of officers who were not stockholders thus working a grave injustice A proposition was submitted to the receiver to let the matter go till next december by which time the supreme court will probably give its decision and then a special election can be held without causing the th a injury that would be brought about by the placing in office of men who were not sesma fide owners of stock returned missionary elder A L stewart Stews rt of kanab kane kan i e county arrived in the city june 12 upon his return from a mis mission siou he departed from utah n may slat 1887 for now new zea lan land darid and from the time of his arrival in that country until april ath in the following year he labored in the districts of poverty bay and mahai mabal thence he be proceeded to new south wales the remainder of hia mission being passed between sydney and victoria at the pros pres j ent time there are two missionaries only nl belonging to the located in victoria and one in id new south i wales elder stewart did not meet with very much encouragement in his several fields of labor there was very little inquiry concerning the gospel although the meetings were generally fairly attended and the people were kind and bo hospitable bitable towards the missionaries on n one or two occasions the latter met with some little opposition and once they were threatened with violence but left the neighborhood while the robbers were organizing in order to avoid a disturbance during his absence elder stewart officiated at three baptisms he left sydney on the homeward journey on may in the steamship new Zealan derand wils was accompanied to utah by brother myers and his three children from victoria sister mcdonald and her four children from new zealand brother james nicholls from sydney and peter cooke a boy of 14 a convert from sydney the ocean trip was a most eda enjoyable OY one and elder stewart and party part are in excellent health and spirits spirits increased registration the of 1602 over the last registration in september 1888 aud and 1771 over june 1888 railroad accident in ireland on 3 junob u no I 1 alth I 1 th a railroad trai train a was wrecked near armagh ireland said to be the worst railroad disaster that ever occurred in that country on the all the shops in armagh were closed and the people were in mourning the train was loaded with children excursionists excursion lats the engineer fireman and guard of the train and the traffic managers manager s clerk were summoned before a magistrate and remanded on a charge of being responsible for the accident I 1 the shrieks of the children were horrible many were mangled beyond recognition there Iss is scarcely earcel a family that has not some one dea dead T and in many cases whole famil families es were
