In addition to inundating the campus with painted sheets billowing in the breeze, the New View and The Edge chose to use a new advertising medium college radio station KGSU. Using the station u asnt without its controversies, said Steve Fox, election committee chair. As a station, KGSL1 cannot accept paid advertising. The spots for The Edge were offered as free public service announcements. However, lawyers with the Federal Communications Commission in Washington, D.C., give differing opinions on the legal basis of the campaign spots. Section 315 of the Federal Communications Act states that if a broadcasting station allcaw s one legally qualified candidate for public office to use its facilities, it must afford equal opportunity to all other legally qualified candidates for the same office. The law also notes that the station does not have a solicit the appearance by the other candidates, but it does have to give them equal time, equal facilities and comparable costs if the other candidate does appraoch it. Ben Felix, The Edge candidate for senate, also serves as the radio stations student manager. Felix and Darin Bird, head of The Edge, said the station was an easy medium to reach SUSC students. Bird said The Edge began to run ads for their campaign Feb. 23. Fox sais he was unaware of The Edges use of the campus radio station, until he was approached about it Friday. He believes that both political parties should have equal access to use the station for campaign announcements. Felix and Bird agree with that decision and said they informed Tony Pellegrini, the director of student activities, that the advertising option would be open to the other party. Mark Waters, head of the New View, said he was "r.uware of the option. Waters said he was surprised when he heard the campaign spots for The Edge on KGSU. Although he said he was hesitant because of Felixs position at the station, Waters approached the station for advertising and produced a commercial with Felix for the New View on Monday. The original non-prof- it commercial was accidently erased and a new one was made Tuesday. Current election bylaws make no provisions for the use of campus radio advertisements because the college station has never before run campus political campiagn announcements. Fox said next years election bylaws would include a clause about use of the campus radio and television stations. Fox may even recommend that future student administrators at the radio and in the campus television stations remain elections like The Thunderbird has on its own volition to avoid any individual conflicts in interest. As the administrative adviser to ASSUSC and the supervisor over student elections, Pellegrini said his office would work on the legal ramifications of the Communications Act over the next few months. The state Attorney General didnt want to make a decision on this too quickly, he said. Tentatively, Pellegrini noted the Attorney General did tentatively say the station would have to provide the same opportunities to both parties in the future. Lawyers at the FCC offices in Washington, D.C., could not all agree on the interpretations of Section 315 for KGSUs purposes. Attorney Sharon Martin of the commissions political broadcasting bench, said the college, as an extension of the state of Utah, would have to provide equal opportunity to all qualified candidates or parties and the station would have to match ad spot for ad spot going back for seven days. Bob Baker, another attorney there, said that it really didnt matter. He didnt think a student election qualified as a real election. A third attorney, their station, supervisor at the FCC, said as a KGSU could not sell or give material that advocates products, commercial services or candidates. This whole radio thing caught me off guard. Next year, the election committee will have provisions for it, said Fox. Other than the radio announcements, the campaigns were run fairly and Fox said he didnt levy any campaign fines. Most reports of campaign violations were simply complaints without any proof. Bird said he would probably keep the structure of the current executive council and cabinet, Cabinet positions would stay the same, Bird said, but the titles will change to match the job description. The final job titles and descriptions will be worked out by Bird and his vice presidents during the next few days. A list of the positions will be available Monday with the application forms. Bird encourages any student to apply for any position they feel they qualify for. We havent promised anything away yet, he said. Moe feels good about year in office (continued from page 1) their pluses, minuses and controversies. He says he would like the new people coming into government to keep a positive attitude, and remember you're here for the students. Moe says Ive asked for more than a 100 percent from student government members this year and theyve all come through. She says she is also happy that both parties are stressing continuing what weve started. That speaks for itself. Administrative Vice President Stacy Buchanan thinks they have had a lot of success with this years activities. She says the thing she is personally most proud of is the new school fight song. She says for incoming government members, I will really emphasize budget training so they dont get surprised. There are so many little things you dont think to budget for. She also says, I hope students know we cant have big activities every week without a lot of support and help. Activities have been the best we could do in the time we had. I hope students appreciate what executive council has done. Buchanan says one of the most difficult things for her was keeping everyone motivated. Although members of the student government arei campaigning for different parties, or even running for different parties, they are stressing a cooperation between the parties. Academic Vice President K.C. Jones says he would like to see people from each party making an effort to be friends with their competition. He thinks there should be a spirit of cooperation during the elections since they are all working toward the same goals. ASSUSC leaders have also been very happy with their relationship with the administration. Smith says, SUSC is very Out faculty is very student-orientefortunate. Wareham says, They tell us what we need to hear, not always what we want to hear, and says hes pleased about that. As she is readying to leave office, Moe says she would like to see this administration remembered as one that cared about the students and made a difference. She says, Student government should be an organization to make college life the best it can be for students.
