prosecuting his labors in that direction i tarther larther he again started on the d of last january to the same reelon reglo and has labored since kince throughout pennsylvania and some portions of elizabe th ann starkey and took her before commissioner mckay where she was informed the marshal had liberated her by mistake the ground for this action lies lil iki in the fact that on june miss starkey was sentenced to one days imprisonment and to pay a fine ot of 50 and in default of payment she was ordered committed t ed on the of june she was sentenced to one days dails imprisonment and aline allne a nine fine of loo aw also for contempt the second sentence to go into effect at the expiration of the first she was afterwards taken before the grand jury and on refusal to answer certain questions was ordered committed by judge zane at the close of the april term of the district court miss starkey was released on bonds to appear before the grand jury yury ot of the september term yesterday the e Al marshal arshal was reminded by some one who was no doubt annoyed by her being at liberty and im am mediately ordered her arrest commissioner mckay set the hearing of the case for 10 this morning and meanwhile the lady was ns sent gent to the penitentiary at 10 am today to day miss hiss starkey filed two applications for discharge one tinder under each sentence stating staling that ane had served the required thirty days and had no means with which to pay the fine marshal ireland then certified to the imprisonment as claimed mr kirkpatrick stated that it had been impossible for the petitioner to make application hough willing willim to 10 do s so 0 for release on the first ca commitment maje in e rit at the expiration of thirty days as she was confined at the time under a commitment from the third district court she should therefore be entitled to the benefit of a discharge the commissioner said it was not impossible as miss bliss starkey could have answered the questions of ane grand jury and have been purged edof of theaon the contempt before the district court lie ile therefore held that she was entitled to discharge on the first commitment but as the second did not go into effect until the expiration of the tile first it did not com cosmetic commence melic until today to day and ordered that the ariso prisoner be remanded to the custody of the marshal marshai until the second s sentence eutence was satisfied mr bir kirkpatrick immediately applied for a writ of habeas corpus and the quest question on was set for heaning hearing earing 11 at
