territorial superintendent of district schools presented the following to the board of canvassers engaged in cail cari canvassing the election returns return s SALT LAKE CITY utah august 1885 honorable board of canvassers your petitioner 0 3 F whitney would respectfully represent that he is a citi elti citizen zen of the united states a resident of utah territory and a qualified and registered voter therein that at the election held in said territory on the first monday in august was a candidate for the office of territorial superintendent of district schools and votes were cast tor for or him at said elec clec election tion lion for said office and your petitioner respectfully ully requests that the votes cast for each endl endi c date for said office be canvassed and counted and that the board issue to your petitioner a 4 certificate of the number of votes cast for him at said election f for or said and certify the same as provided by law 0 r F at the meeting of the c canvassing boar board dand and the utah cammi commission aslon this morning the petition was read and mr kirkpatrick 1 counsel for mr sir whitney said tha that t in the event of the office being elective the votes should shoud be counted and the result declared he was aware that the attorney general had given as his opinion that the office was appointive but this was not conclusive and it yet remained f for or the courts to determine that point he did not expect a certificate of election to be given but asked anat the votes be counted that the question might be tested in the courts ile he simply wanted the fact of the votes having been cast attested and thought the commission could not ref refuse use such a reasonable request P H lannan asked whether if the board of canvassers refuse to count the votes as requested could they be required by mandamus to do so secretary thomas read the commis co amis sio ners instructions to the canvassing board which gave power only to couet count for commissioners to locate university lands and county and precinct officers mr kirkpatrick requested the utah commission to authorize the canvassers to make the count governor ramsay asked how long it w was as since the votes for superintendent of district schools had been counted and was answered not since the appod appointment of the utah comm commission is W W riter su suggested ested that the commission had stafia stated the board of canvassers were a substitute for the county boards who had formerly counted the tile ballots in that case they had no power to say what offices were and were not elective and should count the votes the request of mr whitney was a very reasonable one only asking that a record of the votes be made col godfrey stated that the board of canvassers only had authority to count the votes for offices designated in their instructions gov ramsey said the power of the commission in the matter of elections was very sweeping and it was their duty to determine who was voted for it had been the opinion of the commit slon sion that this office was not elective and the Attorney General had bad sustained th that at opinion mr lir kirkpatrick stated that the attorney generals opinion was not binding on the courts who might set it aside the petitioner only asked that a sufficient foundation be given him io lo appeal to a judicial tribunal and it would certainly be un unjust to deprive him of that right it might b be the only competent evidence vi dence and it 0 was for this reason the tho request was made the board of canvassers evidently had not
