Show TIIE THE WHITE CASE THE CHARGE OF POLYGAMY ADDED at 4 on saturday afternoon the witness in the case ol 01 chas chaa L white charged with una unlawful awful cohabitation wa s br brought oili ht before commissioner mckay and m the questions she wd had formerly declined answering read to her she still persisted in her refusal and the commissioner informed her that the offense was a serious one the law providing for only one days imprisonment for contempt the district attorney stated that if that was ahe the limit of punishment he would take no chances of letting the witness get pet her freedom but would ask that the examination be bee held on sunday the commissioner however sentenced the witness to on one days imprisonment and to pay a fine of 50 30 and t to b be committed to the ille custody of the marshal until paid the examination was then continued guptil 10 a in today to day and miss starkey starkes was taken to the penitentiary this morning the witness was brought inand the examination further continued until 2 this afternoon the defendant was however arrested on the additional charge of of polygamy at p m george white was called as a witness and testified that he was father of the defendant visited i his house occasionally knew defendants wife margaret H white he married her six or seven years ago had seen elizabeth ann starkey knew but little of her and did not know where she lived had seen her at defendants house elizabeth ann starkey was called as a witness on the polygamy count Mr Dickson as asked adare are you a married lady A I 1 decline to tat answer Q arc you married to defendant A 1 decline incline to answer Q llave you a abany any auy time within the past three years gone through a marriage ceremony with this defendant delen daut dant in thi th id county A I 1 decline to answer the commissioner asked witness if she had any reasons for refusal ind and was answered that she declined to answer any questions Q do you refuse to answer voluntarily or because you are instructed A I 1 do it of my own free will Q do you know the tile consequences A I 1 am not particular the court then stated that a fine of would be imposed for contempt and that the witness would committed until the tine fine was paid to which miss starkey replied you may as wel wei make it imprisonment for life at once olice 11 im not particular the case was then continued until 10 am to tomorrow morrow and miss starkey was taken out to the penitentiary the defendants bonds wele fixed at 20 2000 which were not given iven |
