Show r ai memorial ME E morial X 0 R I 1 totne to the honorable senate and house souse P of representatives of the con of the united states GENTLEMEN your memorial lats the Gov governor einor elnor and le legislative assembly of the territory of futaba utah hereby respectfully represent that there th ere are large tracts of land in the regions ot of the bocky rocky mountains which are useless for cultivation until by the construction of expensive canals and ditches water is conducted upon them for the purpose of irrigation that settlers upon such lands who endeavor to comply with the provisions of the homestead act are frequently compelled to cease their residence onlin in consequence of the lack of water for domestic purposes or the brackish andun and unwholesome nature of the water i there obtained from froni u un the construction of canals for irn irrl gation water wate r is brought through such land suitable for general use th that at upon the near completion of a canal passing through buch such land persons who have neither leither resided upon it nor assisted in the construction st 0 of f baid said canal but who have watched for such an opportunity tu naty enter upon the land and by preemption pre emption or otherwise obtain possession to 06 the great injury of the settler who was vas unable to 0 reside u upon pon thel the iano land that the la labora boron on and cost t of construction of subh cabals canals or ditches is often more than equiha lent to the value vaille of budh guch euch residence onland on land aswill as will meet the requirements of the homestead law and that the general benefits to the country accruing from the building of such canals are far in ex excess eess cess of those arising from aid said re residence ce therefore your memoria lists respectfully fully ask your Honorable Body nody to extend by appropriate legislation the benefits bene rits of the provisions of the homestead and other land laws to bonafide builders of irrigating canala and ditches indich ini int ich leh a manner that so much cleans means or labor expended on ot such canals may be counted equivalent to a given time of residence on the jand proof of such expenditure to be given bafo before rd the land register by certificate of the irrigation company engaged in the construction of such canal by the testimony of witnesses as required in relation to residence or such auch other means as your hondr honorable body bosy may require buch such legislation would secure many maity honest working people in lit their rights encourage the construction st of irrigating canals and the tha settlement upon and redemption of much land now conal conil considered dered waste andreat and meet meau meet meat conditions condi condl dons that the desert land liand act does not reach and to td which said dald act does not apply I 1 the fhe early attention of couthon youn your honorable body to this important matter Is earnestly requested and as in duty bound your memoria lists wili will ever pray t february 1878 |
