| Show RELATING TO CO THE TSE ELECTIONS au AN OPINION ard arb AND AID OP OF THE SALT balt bat sat T LA ilare CITY june 1311 1883 isu aiex alex llam ilam aay chairman of the communion commission bin bir your committee committie appointed on may ath to examine and pud report in relation to tho the offices to be filled oiled at the august election in 1883 respectfully fully reports that there are to be elected members of the Leg neg legislative iala iaia assembly in all the ler leg legislative districts of the territory and aiso niao certain county and precinct officers As to those ont oft officers leers who should have been elected tat Lat at the august election in 1882 wo we find that by law some of them are to be elected for a certain number of years some for a given term and grand until their successors are qualified fled gand cand and some for a given term and until their successors ure are elected and qualified ll 11 in regard to vacancies and the tima and manner of filling them the local laws are difficult of construction st in view of subset subsequent bent congressional legislation but in deference to the decision 0 of if the bu preme court of utah as to vacancies in the case of kimball vs bich rich arasin 1882 sustaining the appointment of the governor of utah we are of the opinion that all offices which should have been filled at the general election in August 1882 are to be filled ailed at the next general election in august 1883 for the term we are further of tha the opinion that the offices of territorial superintendent of district schools territorial auditor of public accounts territorial rial treasurer and Commissi commissioners onen to td locate university lands a nrc arc J under the organic act of the territory of utah to be appointed by the governors governor with the assent of the legislative council and that th the acts sots of the legislative assembly D providing for those offices by an election of the people are in con filet illet with said organic aoi act and are therefore invalid respectfully A B CARLTON G L godfrey ey committee the report was adopted and the following order made that at the general election to be held on monday august 6 1883 there are to be elected members of the legislative assembly in t he the several legislative districts of the territory and also certain coun conn county ty and precinct omm off meers officers and that all county and precinct offices which should have been filled at elt the august angust election 1882 are to be filled at the august election 1883 for the time |
