Secretary Utah Transit Authority October 12. 1972 By &FOUND e application of ttz Utah State Rood Commission was filed w.th the Public Service Commission of Utah on Setpenther 8. 1972, seeking permisSion to reconstruct the viaduct over and across the right of way and main yard tracks of the Oregon Shortline Railroad and its lessee, Union Pacific Railroad COMPOTIV, at railroad Post 36.21 which is located between Hipway Engineer's Stations 34487 more or less and 4167.50 more or less the viaduct being located on North Temple Street In Salt Lake County. the project being identified as It appearing to the Commission that no formal hearing is necessary in the matter, and that this application may be aporopriately handled under the Commission's summory procedure, and a fall investigation of the matters involved having been made, the Commission now makes this Report containing its Findings of Fact. Condosions and Order. FINDINGS OF FACT 1. The Utah State Road Commission Is on agency of the State of Utah, authorized to construct maintain and supervise State roads and matters relating thereto. to recon2. Petitioner proposes struct the viaduct over and across the of and main way right yard tracks of the Orogon Shortilne Railroad Company, a corporation of the State of Utah, and Its lessee, Union Pacific Railroad Company, a corporation of the State of Utah, hereinafter referred to as the "Railrood", the proiect being located at railroad Milepost 36.21 which is located between Highway Engineer's stations 3187 more or less and 4167.50 more or less of said project and is more gthrticalarly 2 of the described in Paragraph agreement between the parties as tiled with the Commission. 3. The Road Commission shall at its sole cost and expense perform all work and furnish all materials in conof nection with the reconstruction said viaduct over and across the right of way and main yard tracks of the Railroad. The Railroad shall, at the expense of the RJad Commission, perform all work and furnish all materials required in the rearrangement at any wires, lines, signals, right of way fence or Other facilities of the Railroad. I. Under the provisions of the Public Roads and Policy Memorandum 21.10, dated October 3, 1958, the Road Commission shall, upon rendering of bills thereafter by the Railroad, pay to and reimburse the Railroad for all work performed. 5. A copy of the aforementioned agreement with the Railroad was submitted to the Utah State Public Service Commission and made a port of the petition by reference. The agreement contains a detailed estimate of costs, prints and drawings showing the exact location of the project. 6. The Commission finds and concludes that the reconstruction of the viaduct will be in the best interest of the public and that the application should be granted under the conditions and to the extent set forth above. ORDER NOW, THEREFORE, IT IS HEREBY ORDERED, That the Utah State Rood Commission is authorized to reconstruct the viaduct over and across the right of way and main yard tracks of the Oregon Shortithe Roil. rood and Its lessee, Union Pacific Railroad Company, at railroad Milepost 36.21 which Is located between Highway Engineer's Stations 3187 more or less and 4167.50 more or less, the viaduct being located on North Temple Street in Salt Lake County and the proiect being identified. as the provided Parties comply with the conditions set forth above in the findinas IT IS FURTHER ORDERED, That a copy of this Report and Order be served by mall on the Union Pacific Railroad, the Salt Lake County Commission and Salt Lake City Commission; that the contents of this Order be published in a newspaper of general circulation within the State of Utah and the area involved for at least two issues with proof of publication to be filed with this Commission within fifteen days of the dote of this Order, and unless protest is filed with this Commission within twenty days of the date of the first publication thereof, this Order shall be in full force and effect. Should any Interested party file written, timely and meritorious Protest the Commission may in Its discretion set the matter for hearing or for further consideration.
