Show THE NEXT xa ASSEMBLY A rp THE tre ax returns from ohp th diali different erent counties of the territory Terri tor have been received and canvassed by the secretary who has haa T act tr thereof aa as required by law from this Ws it appears that the following gentlemen have been elected to the tiie twenty fifth session odthe leg s la tive assembly to the council ii from beaver iron and plute pluto counties john K R murdock murdoch om box elder and weber lorenzo Ii orenzo snow cache and rich mos most thatcher davis salt lake and f joele joeie joseph ose li P F smith daniel dabiel B H wells wella jo john M T caine and peter I 1 arton n ba san Ban pete sevier and emery A K R thurber T utah and juab A 0 sm smoot oot and george newdale Te wdale Washington rane Kane and suu ehu juan JS rastus snow wa batch and morgan NV V clum ls 12 to the house of representatives and plute flute counties 3 H blackburn from iron and an juan edward dalton box 0 JG snow weber lorin farr and D H peery cache and richa W B preston and W H uee jee morgan salt bait lutke like and tind davis I 1 rohn ohn H siy sri Snaith Hosea stout jame Jam r i i S sharp john jaques 0 W penrose perose and samuel francis tooele thoele F 11 lyman sanpete San pete sevier and emery canute peterson and henry beal utah utah and juab W H dusenberry J E booth J S page and S E R thurman summit B S F atwood washington and kane VV D johnson wasatch abram hatch hitch 23 according to these returns the assembly is one member short and millard county is without a representative senta tive that county cording according ae to the latest apportionment elects a councilor in coda conjunction unction er plute and iron Countie sand one ono representative alone no returns of such auch election have come from millard Buton nuton but on inquiry we learn that the election in millard county was duly helfand hel dand john R murdock murdoch received the popular vote for councilor and E dward edward partridge for representative boother no other candidate was voted for foro it appears that the county clerk in making the returns for some reason not apparent neglected to comply with the law in relation to the election of those cers cera if no returns had been received from millard the secretary no doubt would have waited for them before making out his big abstract but returns of the election of other territorial rit officers were forwarded from millard these being omitted the question is what can be done Is millaid millard lo 10 be in the lower lowen lowerhouse house of the assembly section 25 of the act of 1878 regulating the manner of conducting elections provides that auy any omission or irregularity of any assessor or other officer pertaining to election matters shall not invalidate any election or authorize the rejection of any legal votes cast except to the extent that such irrea irregularity or omission shall have prevented a fair vote thero there Is no doubt that edward partridge was duly and legally elected representative from millard county anty the only defect is an omission or irregularity of the clerks must this invalidate the elec electa election tZ we think not legislative bodies tolles in the united states are the judges of the qualifications of their own member and proofs can doubtless be obtained of the election which will be sufficient to gain the seat particularly as there is no contest we think that the county clerk should at once do what he canto can to lt rectify edify his big error lin ITA jaho jako si ouid id immediately forward to the secretary a certified copy of the persons voted for and the number of votes each has received 11 the secretary is required to forward a certificate of election to each member elected within ten days after his big abstract is made out whether he can give a certificate in this case is for him to de determine but in any event there is no necessity lleces for millard to be deprived of its proper through the neglect or misunderstanding of the county clerk all the meers officers off of the law should be care eare fil to comply with the law in every respect and it is to be expected that prisons pra sons elected ejected to the various offices in the gift of the people will qualify themselves for th the 0 posit positions 0 us they an ana called upon to fill not only by taking the necessary oath and filing bonds but by becoming familiar with the duties and responsibilities imposed upon and entrusted to them |
