Show homesteads and pre pro emotions relief tor lor settlers nett hett rora lera nho who n bo anve from department OF tim THE INTERIOR general land nand office washington U 1 D 0 it june jone 0 0 i 10 24 18 7 7 Rg steta stera and rec Kec receivers eivers of united ii 5 slates states land offices gentlemen Re erring to my cir cular dated october relative to acts of congress of december 28 1874 may 23 1876 and june 19 1876 for tho relief of settlers whose whose crops have been destroyed de or seriously injured DJ by grasshoppers your attention is called to the act of ceng cong cen Con congress gress gresa res approved march 3 1877 entitled an act fon foe the relief of certain settlers on the public lam law lands as A which la is as follows jap i B e it enacted by the tho senate and house of je representatives 8 of the united states of america in congress assembled that it shall bo lawful for homestead and pre emp tion settlers on the public lands or preemption pre emption settlers on indian res where crops are destroyed tro y ed or seriously injured by grasshoppers in the year eighteen hundred and seventy seven to leave and bo be absent from said lands until the first day of october eighteen hundred and seventy eight under such rules and regulations as to proof of thesa thess the same meas as the commis bloner of the general luand rand office shall bhail prescribe and where such grasshoppers shall reappear itu lif eighteen hundred anu shu and ann i seventy eight to the like destra atlo ilot injury 1 ef of crops the hight right t to td d llave and be absent as aforesaid shall continue to october first eighteen i n huri huzi hundred dred and arid seventy nine and during such absence hb adv adverse erse elbe rights nights shall attach to lands such settlers being allowed to resume and find perfect their settlement as though no such absence had bad occurred bec SEC 2 that the time for mak male ing final proof and payment by pre whose crop shave been destroyed or injured as hs afore hereby extended for pil ppe ope year aftel L the expiration of oe the term of absence provided for in atlle tue the first e section ec of this act and ail all the kight rights and and privileges extended by this ae act to homestead and preemption pre emption settlers shall apply iipp ly to ardd arid include the settlers under tinder an act entitled an act to encourage the tho growth of timber on western prairies Y approved march third thim eighteen hundred and seventy three and all dalee dAlie the acts amendatory thereof 4 the first section of this act provides for the leave of absence and protection of rights of homestead and preemption pre emption settlers where crops may be destroyed destroy ed or seriously injured by gras ersin theeart the tle years ears vears of 1877 and 1878 under such buch e rules and regulations as to proof of the L ame lame as the commissioner of general genea 1 l land laud office offic i e shall hill pi prescribe ethe the second section extends the time for maff making ing final p proof roaf a and i nd payment by pre whose crops have been destroyed destio ed or injured as aforesaid one year after the expiration of the term of absence provided for in the first section of the act viz one year from october 1 1878 or one year from actu october ber 1 1879 and the second section of said act also extends the rights and privilege ibe the net act to L settlers under an act entitled an act to encourage the growth of timber on the western western vestern prairies j approved d march 3 1873 and the acts amendatory thereof all legal settlers flers sem sef of the character mentioned at the date of said act of march 3 1877 which Is the subject of this circular as well as all who may lawfully settle within the th 6 time included within the limits of said act mar march i ch to december 31 1878 are alre entitled te to the benefit of the same written notice of intended absence signed by the party should be fi filed ledwith with the register and receiver when he leaves his claim and be noted en on the tract books this forthe for the protection of the claim annand as notice to otherwise make settlement and attempt to obtain title when final proof ligado is by any settler bettler who has availed d himself of the act proof must lie be submitted showing the period of absence and its necessity and that he has resumed his settlement the affidavit of the party interested corroborated by two or more witnesses will be deemed satisfactory jol tol proof very ry respectfully respect guily fally ll 11 1 A commissioner |
