commence on the fourth day of march net thereafter SEC 26 the time for elections in any state district territory for a v representative delegate to fill a vacancy such vacancy is caused by a falion failon to elect at the time prescribed b law or by the death resignation or incapacity of aberson a person electea elec elee tet tei may be prescribed by the laws the several states and terni Terri torne torie rW respectively SEC 27 all votes for Re repress natives in congress must be tf li written or printed ballot andai votes received or recorded ar te to this section shall be of no effects eighteen hundred and seventy one oue SEC 1860 at all subsequent elections after the first ho however weve in any territory hereafter orz org organized anizell zev by congress as well as at all el elm eions in territories already org orp nihed the qualifications of votes and of holding office omee shall be suei suet j as may be prescribed by the legisla tive live assembly of each territory subject nevertheless to the following restrictions on the power of th thi legislative assembly namely first the right of suffrage ada ana of holding office shall be exercised only by citizens of the united states above the age of twenty one years yean and by those above that age who have declared on oath before a competent court of record their intention to become such and have ha taken an oath to support the constitution and government of the united states second them there no denial of the elect elective ve fral frat franchiso franchise ichiso or of holding office to a citizen on account of race color or previous condition of servitude third no officer soldier seamen mariner or other person in the army er or navy or attached to troops in the service of the united state shall be allowed to vote in any territory by reason of being on service therein unless such territory I 1 is and has been for the period of six months his permanent domicile fourth no person belonging to the tha thearty th eArmy army or navy shall be elected to or hold any civil office or appointment I 1 in ii an any y territory ory ony SEC 2004 all citizens of the united states who alre are otherwise qualified by law to vote at any election by the people in any state terri territory ry district county city p parish ar 1 s to township school district municipality or other territorial subdivision shall be entitled and allowed to vote at all such elections without distinction of race color colors or previous condition of servitude any constitution law custom usage or regulation of any state or territory or by or under its authority to the contrary notwithstanding revised statutes SEC 6 that section 25 05 0 5 of the revised statutes prescribing the time for holding electa elections ons for representatives to congress is hereby modified so as not to apply to any state that has bot not ret jet changed its day of election elee elec tion tien and whose constitution must be amended in order officers not herein otherwise provided for utah organic cAc act 1 UTAH TERRITORY LAWS hec SEC S F b 1 be il it enacted 1 by the governor and legislative A assembly of the territory of utah that annually on the first monday of august there shall be a general election heid held in each precinct in the several counties for choosing all officers not otherwise provided for SEC 2 the T county clerk shall cause a notice of the time and place and the num berand kind of officers to be chosen to be put up in two public places in each precinct at least six days before the time of of election sm SEC 3 the tho he senior justice justlee of the peace shall be the judge of biec blee in his precinct and shall appoint one clerk and furnish the necessary stationery and a ballot box and in the absence of a justice of the peace the electors first assembled on the day dak of election 1 to the number of six may app appoint 0 int some suitable person as judge of that election SEC 4 the election shall be heid held from one hour after sunrise until sunset and no elector shall voto vote in any prec pree precinct luet luct excepting where he resides SEC 5 each elector shall provide himself with a vote contain 1 jag dag the nables names of the thie persons he wishes elected and the offices he would have them thern to fill 1111 and present it neatly folded to the judge of the election who shall ri timber number and deposit it in the ballot box the clerk shall then write the nam name of the elector and opposite it the ithe number of his vote SEC 6 at the closer of the election the judge shall seal u up p the ballot box and the list of the names of the electors and transmit the same without delay to the county clerk SEC 7 immediately receiving the electoral returns oraby pre precinct ca net the county clerk anif and ar probate abate judge or in his absence one of the selectmen shall unseal thelast the list and ballot box and count and compare the votes with the names on the list and mg make ke a brief abstract of the offices and names voted for and the number of votes each person received the ballot box shall then be returned arid the votes vetes and list lit preserved for reference in case tho the election of any person persons shall ball be contested SEC 8 when all the returns and abstracts are made the clerk shall forthwith make a general abstract and post it up in his office i and forward to the Sec bec secretary V of the territory orya a certified copy of the names of the persons voted for and the number of votes each has received for territorial offices and furnish each person having the highest number of votes for county and wad precinct offices a certificate of his election SEC 9 so soon as all the returns are received the secretary in the presence of the governor shall uni seal and examine them thern and furnish to each person having the highest number of votes for any territorial office a certificate of ot his election SEC bec 10 if tho the returns are not made madd within a reasonable time the secretary or county clerk as the case ma may be shall institute iii la which must bo prom promptly Vily responded to and a new now abs abstract tract furnished if necessary SEC sta 11 any person designing to contest arr election shall make his intentions specifically i known 4 in writing to the county clerk within ten days alter tho result of the election ia is known in which case the clerk shall retain the votes and lists until the contest is decided otherwise he bhail shall destroy them SEC I 1 12 when ties occur if for a territorial officer the secretary shall determine the election by lot I 1 la tho pie presence plesence senco sence of the Go governor vernot and if for a county or precinct officer it shall in like manner mann er be determined by ey the county clerk in the presence of the probate judge SEC 13 any person contesting the election of a cou county n ty or precinct officer shall proceed therein before the county court who shall determine the question all of which shall bo be done dote without delay SEC BEC 14 when a vacancy occurs in territorial elective offices the governor shall order af d special election to fill such vacancy and should a vacancy occur in a county or precinct office necessary to be filled previous to the general election the county court shall fill such vacancy by appointment SEC 15 all ail off meers officers acting in elections shall bo be allowed a reasonable compensation for their services and shall be punished with a reasonable preventive amount of fine for fraud or election SEC 3 no person shall be elected or appointed to any territorial district county or precinct office unless he shall hao hae have been a constant resident therein during at least one year next preceding such election or appointment neither shall any person be entitled to hold any office of trust or profit in th the 0 territory or vote at any olde eige election tion unless he ia 13 a free white male citizen of the united states over twenty one years of age and has hag been a constant resident in the territory during the six months next preceding said election or appointment SEC seca 5 and be it further enacted officer or soldier of the united states army or other person subject to their military authority is bli wll eligible gible to hold any office or serve on any jury or vote at more than once at auy one election or knowingly offers ers to deposit two or more ballots or changes any ballot after the same has been deposited in the tho ballot box or after the election adds or attempts to add any ballot to those legally polled shall on conviction thereof be fined in any sum not mot elcee exceeding ing twenty dollars for each ore e and any person who carries a away a or de destroys strays or attempts attempt a to carry away or destro yany poll list or ballots or ballot box for the tho purpose of breaking up or invalidating such election or who wilfully deta detains 1 ins matila or destroys any election returns or in any manner ao so interferes with the officers holding such election or conducting such canvass or with ahe tho voters I 1 lawfully y exercise
