according to adjournment of tuesday last this case taso was resumed at two yesterday alestra Al essra haydon and maxwell for lor the prosecution and mr miner fon ron or the dorease defense it if will be remembered that mr miner ulner made a motion ta quash ther thew complaint against mr phillips beba because tise tige it contained two specific charges under two different sections of the statutes the court pur put the prosecute prose cut ent on on thel as to which charge should be proceeded upon land the complaint was amended artion ded so aa asi to contain bu but one pe specific charge under section ilof tl the criminal code the affidavit against mr Phit kips tips was waa made by gearge R maxwell mr phil kolhler Kol koi hyen hyer a burty Geri gori oermann butcher was the first witness wi that when policemen at tempted to arrest arrett parties without a warrant the latier latler should shoot them down like dogs and that others had expressed the same ideas although not quite so strongly the court knew know that such counsel was indirect in direct opposition to the law which es ei pressly provides that not only a police officer but even a private citizen had the right to make arrests when there was probable cause for believing that a crime had been committed I 1 and it was time that such matters were settled the tendency of the course pursued by some lawyers was to encourage resistance to the officers tle tte cross examination of kolhler Kol hyer by the defense was then resumed witness had his pistol ou on when taken to the city halia hall and it was a id d d good thing struck and should such resistance be pro ved it could only be viewed as extenuating evidence if the prosecution could prove the act itself on afi the accused with which the latter iatter was charged
