and surveyor general generis asmith mith the tho following preamble and n li 11 re resolutions were nere unanimously adopted WHEREAS it appears from fim fum davits and other evidence before us I 1 that on the ard rd day of august A D 1874 the electors of meagher county cast votes tor for the approval of the capital law and twenty nine votes for the disapproval of said law and that upon the loth lay day of said sald month the county commissioners commis I 1 of the county of meagher Meag ber to together gelber with the probate judge thereof met and canvassed ball balf vote and it was found to stand for the approval and disapproval of the said sald law as above stated that the abstracts of the said vote were made out in duplicate and both signed by the county commissioners and probate judge that on the day of said month one tone of the abstracts so attested by said commissioners and probate judge with the certificate of the county clerk and Re recorder corder cordet of meagher county attached was delivered in an envelope unsealed by the county elerk clerk to william davenport davenpor a trustworthy rus worthy citizen of lewis and clarke county to be taken to helena and from there transmitted by express to the hoto horo J E cal cai callaway laway secretary of this ahn territory at virginia city that the said davenport brought the ab of votes on the capital law to helena aforesaid and antl in the presence of H A A dacquel DA chuel and henrj henry na M parchen delivered the same to D C corbin that the said corbin davenport J D acherl and parchen then and there examined the abstract of votes cast on the capital law in meagher county and found that motes votes were wera for its approval and 29 29 9 were for its disapproval that after the tile abstract had been so examined the said corbin retained d the same in his poc pos session for about one day and after sealing the same banfe then delivered it to the agent cf well weli fargo co at helena to be transmitted by their express to the tile secretary at alc virginia city that the agent or of the express espre company immediately transmitted the bald said abstract to the office of the at virginia city that the etting elting forth the said sald vote on the capital law was never luany iu any manner mahner altered or changed benore before went inta the office of the express company and whereas it appears that the package containing the aforesaid abstract was allowed by the secretary to td remain in the express office at virginia city for the 06 period of abw abl about out 18 dayland days day sand saud and that when the same was taken from the office and the vote of meagher county was examined by the board of commissioners it was found that the vote had bad been transposed so as to read agi aoi votes for the disapproval end and 29 for approval of the gald gaid capital law therefore ie I e it revolved by the citizen ot le lew w is a and aid ad clarke Clarko county that that it is with feelings of indignation mingled with regret that we review the gross g r 0 ss fraud that has been perpetrated e tm t d by designing villains fur in tre tze the interest of bf vieginia Vi iginia city upon the elector of the entire territory and more especially upon those of meagher county with indignation that an election faud maud f aud so monstrous and subversive of our most vital interests should be perpetrated in our territory and even to meet with the sanction of those high in official station with regret that a any auy ny community within our borders should shelter and countenance the persons who would be guilty of such a crime we will dev dov devote ote our time our energies and our means to the detection and punishment of the miscreants who planned and executed this fraud upon the that this fraud was perpetrated while the said returns of the capital vote i were in their office at said P place lace then we demand the dismissal of H S howell from froba their employ as sis agent resolved that we call upon the hon jas E callaway as secretary of the territory to give us such information asha agha aa he may poses relative to the care and custody of said sald election returns from mea gher county after their arrival in virginia city and if the same L were allowed to remain inthe e e express k emmice effice for th the e period of J 9 days or thereabouts instead of being deposited ilog cited in the Secre s safe ite a in bis his office i this highhanded high handed outrage upon the laws of bf the territory and the dearest rights of an american citizen demand the condemnation dem nation of every honest man in the territory and we cordially invite all who are not in favor of fraud and forgery in every county in the territory to operate cooperate co with wath us
