to the committee on public lands and ordered to be printed A binl BILL 11 L TO ENCOURAGE THE OF ARTE ARTESIAN sian WELLS UPON PUBLIC LANDS 1 4 THE STATE OF NEVADA t s be it enacted by the senate and mouse bouse of 0 representatives of the united states if of america in congress that the public lands ot of the united states lu in the tha state of nevada whether surveyed or surveyed shall be and hereby are dec declared lared to be open to location by citizens of the united states or persons who have declared their intention to become citizens who shall desire to engage in the sinking of artesian wells under the terms and con editions of this act bee bec sec see 2 that there shall be and hereby is granted to every person who is a citizen of the tho united states or who shall have filed a declaration of his or her Intent intention lou lon to become a citizen and who wh oshall shall sink an art artesian eilan well upon public lands lauds in the state of aund put the same in successful operation as hereinafter herein atterb attenb specified peel fled fied a quantity of public lands landi not exceeding in the aggred aggregate ate r acres to be selected by legal subdivisions in as compact is form as aa possible reference bein had to the character and toyogi topography achy 0 the country and to the existence of prior grants or cl claims atins and to include the rile bite dr location of such well provided I 1 however that this graut grant shall not attach to land containing known mines or valuable minerals bec see 8 0 that when a person shall desire to avail himself or herself of the provisions of this act acty it shall be lawful for him or her to select a location upon the public landane lan dand to commence the necessary operations if upon surveyed land notice shall bhail be filed with the register of the land district in which the said location is situated within three months from the date of commencing the sinking of such well which bolce shall contain a sworn statement ty by the party that he or she Is a citizen of the united states or has tiled filed hib bib or her declaration of intention to become a citizen that he or she intends to avail himself or herself of the provisions of this act that he br she has made madea a location of the well and has already commenced operations thereon describing such location as gearas near as may be that he or she has already expend ed in the sinking of said well in labor and money monedi a sum not noi less than dollars and shall describe de cribe by legal subdivisions the land selected in satisfaction of the grant herein contained and state that sueh subh land contains conta his no k known mines or minerals such notices shall be reported by the register to the Commissioner of the general lando f finein the same bame form as preemption pre emption declaratory cl statements and aud shall have the same effect in id reserving tho the land so selected and filed upon in case the location of said well shall be made upon surveyed uh land the applicant shall procure a private survey to be made of the land selected by him or her describing the land sp so selected by mete met sand esaud bounds and well known natural objects and connecting the bame same with the lines of public survey wherever such connection is eble ebie which survey shall be filed with the register of the land district together with the notice above required thereafter when the plot of survey of the township shall shail be tiled filed the applicant shall within three months after the receipt of such plat by the register file with that officer a supplemental notice describing the land claimed by him or her by legal subdivisions taking as near as may be the identical land covered and described crib edby by the private survey when the sald said well shall have been completed and put operation the applicant shall make proof of that fact that the said well turnia furnia furnishes hes either by flowing or by pum pinga supply of water equal to inches miners measurement and that the land selected by hirn him or her contains no known mines or valuable minerals mineral and upon such proof being made to the satisfaction of the register and the receiver the register shall issue and forward to the commissioner of the general liana land d office a certificate of that fact together with the proof submitted and aud the bame be found to meet the requirements of this act a patent shall bhail ie be is the land so selected A duplicate cate oate copy of the certificate so BO to be issued shall be given by the register to the claimant and shall serve the same bame purpose as the tho duplicate da plicate receivers receipt in amea of ordinary entry provided however that iq in case the well when completed shall not furnish the supply of water above specified either by flowing or pumping then the party shall have no right to a final certifies certificate te and patent for the land so selected by him or her but in lieu thereof shall have a preference right to purchase the quarter section upon which such well ia Is situated at the government price and provided further that in case the well when completed shall bhail require pumping to furnish the supply of water above specified then the tho claimant shall furnish in addition to the tha proof above required satisfactory evidence that he or she hab hub erected substantial stant tai ial and permanent nt machinery for the purpose of pumping and that the same is fully completed and in successful operation before he or she shall be entitled to a final certificate and patent for the land selected in case the well shall not be completed ed within the period of one year from the date of filing the declaratory statement first herein required then it shall be necessary for tho the claimant at or before the expiration of one year from the date of filing sueh buch notice to file with the re gister of the proper district land affidavits of two or more disinterested persons showing that the work upon such well has been diligently prosecute stating ed approximately the cost of the work done thereon and the depth to which the shaft has been sunk and in addition to such ammi aill davits the claimant shall present his own affidavit declaratory of his or her purpose to prosecute the said sald well to as early a completion a ai 3 possible the effect of such buch affidavits shall be to continue in force the original declaratory statement of the claimant for one year frona from the date of their presentation in case the well shall be finished before the survey shall have been made of the township in which the same is situated the final certificate shall issue a above provided describing the land selected in accordance with the survey required to be made and furnished by the claimant but no patent shall lesue issue thereon until the survey shall have been made and the plat fixed when the selection shall be made to conform to the lines of survey by bv the commissioner of the general land office such adjustment to be made in accordance with the he suggestion and wishes of the claimant should no valid objection appear thereto but the adjustment so eo made shall bhail conform as near as practicable to the lines of the original private survey I 1 bec bee 4 that in case the original locator of a well as aa above specified should before the completion of the same sell or transfer his or her right therein it shall be competent for such purchaser to complete the same and upon making the final proof herein required together with proof of such sale or transfer the final certificate and patent shall issue in the name and for the benefit of such purchaser or assignee and in case of the death of the original locator of a well vell it shall be competent for his hig heirs executor or administrator to prosecute and complete the same and upon the final proof being made cert eert certificate i ficare and patent shall issue in the name of the heirs of such deceased locator in the form now provided by jaw in pre emp tion cases see bee 5 that in cases casca of contest arising between claimants under this act or between such claimants and claimants under the preemption pre emption homestead or other laws testimony shall be taken and the rights of the parties a rl i es adjusted in pl the same manner as in u p preemption pre re emption or homestead contests and the date of commencement of work in sinking the well shall be taken as aa the date at which the right of the claimant under this act attached to the jand jaud bee bac 6 that for filing the notices and taking the testimony as required by this act the registers and the receivers shall be entitled to the same fees feea and compensation as for filing notices and taking testimony in preemption pre emption cases sec 7 that this act shall continue and remain in force for the period bf 5 years lears ears from the date of al the lawf and we think it may be mainly traced to a laxity or absence of parental authority criminal indulgence to the growing child what may be styled the spirit ol of freedom and independence run niad mad with permission to roam the streets unrestrained at all hours bours of the day and night without any scrutiny aa sis to associations clat ciati lons ions ons or acquaintance formed are we believe the true causes of the youthful depravity which threatens disastrous results in the future what parents with a proper sense of duty to their offspring would permit blasphemy whisky drinking and smoking ou the part of youths scarcely knee high yet is it nat pot notorious orious to every obder observant vant person who walks through our highways and byways that these habits are quite
