as its interesting agthe as ithemar ith ewar v war news at ab about dat oat twenty minutes past bast seven this morning the city marshal john D T mcallister mcallistor esq with captain burt chief of bf police and a corps of eighteen regular and special policemen made a descent upon the liquor establishment of Raul aul engelbrecht empowered with a warrant from alderman clinton and to demolish the casks cases casp bottles ac containing liquor and to lapour out their contents upon the ground round about three or four months ago mr paul engelbrecht concluded to drop the saloon license for the sale of liquors which he had taken out and in the stead thereof applied for a wholesale ii liquor r license which was granted him As will be seen by references reference to the city ordinance relating to licenses for the sale sile of liquors which we append to this article ten gallons is the smallest quan which a person holding a liquor license is authorized to sell except where bottles ac are sold 1 in or original nal nai packages but mr engelbrecht did not nor BO so view the wholesale license for he soli at retail for wh which ach ich he was arrested and fined three times at the expiration of the time for which the wholesale licens license e was vas given e n he applied for its renew renewal al and gh his is ap application I 1 I 1 cation catlon was granted but he re refused setto to sign the bond required alred aired in section eight of tho the ardi ordinance ance I 1 course left him without a license he bas baa been in this condition since about the finst first of the month but notwithstanding he had no license he has continued to sell wholesale and retail during thib this time some twenty six or twenty seven days he has been arrested and on three different occasions fined but be he has taken an appeal against this action of the city authorities I 1 denying their jurisdiction on no decision has been arrived at upon t these appeals as the district court has not been in session since they were made meanwhile he kept on treating the city its ordinances and its officers with the 0 greatest con contempt tem pt Al another iother lother complaint was recently made upon oath before the alderman setting forth that mr paul engelbrecht Engelbrech fe was continuing to sell liquor without license and that V vat gat 1 1 his place it could be bought in any quantity from two bits worth up to the barrel upon which the alderman issued his warrant in accordance with section seven of the city eity ordinance directed to ehfe city Mir marshai marshal shai bhai command ing him to td enter said place and to Idem demolish blish all things found therein used for the unlawful rul fal sellin selling gand and dis posing of vinous or fermented liquors without license armed with this document the city marshal with his hia force proceeded to mr engelbrechts saloon and finding mr engelbrecht was absent having gone out of town yester 9 day of which fact however the officer was ignorant read his warrant to mr chris bohmke and then proceeded to carry out his hia instructions he and the captain of police assigned the men their various duties some to roll out the barrels which were on the upper floor into the street others to go into the cellar and demolish what tuey they found there others othera to knock in the heads of the bar reia rela and others to break the bottles and ewes eases the police proceeded quietly but bui sternly with their duty they used no unnecessary violence and did not break anything tha thal did not hold bold ili lii lii or or kasnot was not middle of the streel street Some strangers in town gathered with the crowd fo to witness the scene seene and they commented upon the fact that nob not a drop of any auy kind of liquor was taste tasted d by the officers the work of demolition occupied half an hour and before ib it was vvs ended about spectators had collected but quiet prevailed and there was no excitement manifested throughout the whole transaction itis with we chronicle this thia act of rigid and necessary justice on thep the part artof of oun our city eity ansary authorities thorl ties the sale of jlou liquors ors in itu our city gity and aud territory except for medicinal purposes we have been thoroughly and uncompromisingly opp opposed used to these are our private feelings on the subject but it has been deemed necessary by the city council after being petitioned petition bd and remonstrates remonstrated with on the subject to td grant a limited number bumber of licenses to sell liquor the propriety of this action i we do not question but in granting thus thu much the council has also aiso taken care to prescribe metes ani aul bounds to prevent the abuse of this liberty not satisfied ho however reve veve r with the privilege r i of sellin lingby sel bel b license icente there has jias pu been e en a disposition manifested by certain evilly disposed persons to trample ale upon and aud defy the authority of the city and pad its ordin ordinance nce nee and officers in this business so much so that they have evir evinced iced a determination to sell liquor whet band fand where they pleased independent of any say license mr engelbrecht has been one of the foremost of these individuals he has the unenviable distinction jot being the first to attempt to test the validity of the city charter and ordinances in the courts on this very question but judge titus decided in favor lavor of the city and that thathy h hs has been persi in lit his apts to over i ride all law and authority in this cinat ter is 9 evident from aiom the fact that this is the third time his establishment has been abated but ho he is not the only one our oar city has a reputation for sabriet sobriety now that it would nott not long ma maintain if men of this class could carry out their thein designs but we are glad that our city off omm officers leers have the nerve to magnify the law and end to use all the authority with which they are invested to check the tide of corruption that seeks to wash down every barrier erected for the maintenance of law and order this laud has been dedicated as a home for the virtuous the industrious and the temperate up to the present virtue and temperance have been honored while intemperance and its long train of vices have been frowned upon and bontem ned who wishes to have it otherwise do the people no their theil influence and voices are utterly opposed to thel the free sale of intoxicating drinks they would have their sale restricted but bata a few council counell ot of great sal SAI 6 lake city that thai it shall not bo be lawful for auy any person or persons to manufacture sell or otherwise dispose of any spirituous ginotis or fermented liquors nor to establish or keep or to assist assiat in keeping er or conducting any house or place fur lor the purpose of manufacturing or belling elling or otherwise disposing of any spirituous vi vinous rious or fermented fermen lermen ted liquors within the limits of this city without firby obtaining license from the city council for such purpose sc SEC 2 that a wholesale liquor license shall not authorize any person to sell barter or deliver any wines winea spirituous or fermen lermen fermented tod liquors in less leas quant quantity ity than ton gallons or in original packages and bottled liquors or wines only in original packages na Rs imported and in no case to be drunk on the premises of parties so licensed licen sed ced SEC 3 that a retail liquor license shall not authorize mado may issue his bis warrant directed dir pro fro the city man mar or any of his deputies commanding him to enter anter a aid eaid hoase house or place and demolish all things found therein made awe use of for the purpose of manufacturing selling in or otherwise disposing of spirituous vio vinous ous ons or fermented liquors and anu and ana to arrest the person or persons 0 owning keeping pr conducting said house or place and bring him or them before the court and such person or persons an conviction snail shall be liable to a tine line not to exceed one hundred dollars and imprisonment not to exceed six months or both fine and imprisonment at the discretion orthe ortho court sex sec 8 the city council on granting liob neos to any person or persons for lor the manufacture manul or aie gale ale of spirituous vinous or lermen fermented ted liquors shall determine the tho time for which it shall be given and the amount to be paid thereon and shall require bonds with security and determine the amount thereof for the due observance ol 01 of the ordinances and regulations of the tho city said bonds shall be approved by the mayor or city council and aud filed with the recorder SEC hec 9 an any y person erson violating any of the provisions of ordinance shall be liable to a fine in any sum not exceeding one hundred dollars and forfeiture of license SEC 10 all ordinances and
