bearing marks of having traveled some distance and it is now thought the mules are stolen the circumstance cum stance of a young man of this city meeting in the vicinity of ing the night that the 3 pm after an u illness of three weeks he lie summered suffered a from a combination cf diseases and had been insensible for several days wm I 1 appleby was the son of jacob and mary appleby and was born august 1811 ne near arthe the village of new egypt monmouth co new t jersey he ho was a self taught man never having attended school after ho was nine nino years of age but by energy and perseverance he acquired a sound english education he ire learned the carpenter and millwright business when a young man and continued to work in that line until 1838 IM when he was appointed justice friday and saturday the court was W as wholly occupied with the trials of thomas knapp and morgan day indicted bytho by the tho grand jury for the murder of jones a colored woman oman living at 09 ogden den on the tho of Apri llast of the particulars of which our readers have been already informed af at the request of counsel the tho prisoners received a d special grecial trial knapp the younger being tried first he made a part partial alcon aicon confession of the deed As the prisoner had no friends nor means to procure counsel his hl honor judge wilton appointed nob hob robertson ertson and maxwell to conduct their defense and the jury after an impartial trial returned return eil etl a verdict of murder in the first degree 1 on saturday morgan day who by the confession of knapp enapp made at ogilee ogden was the onn one who actually did the ged deed was ried but the evidence given was not strong enough to satisfy the jurors that he was guilty and after retiring to deliberate they returned a verdict of not guilty and the prisoner was released this morning the prisoner knapp was arraigned before the court and after a few well timed remarks by his honor he ho was granted his choice of one of three deaths which the statute statute provides for condemn condemned il criminals after choosing to be shot the court pronounced the following verdict it is ordered and adjudged by the court that you thomas knapp having been convicted by a jury of your country of the crime of murder in the first degree be taken hence by the marshal of the territory to some safe and
