treaty and likely would not be charged with the death penalty offense now Caine said Daines told the judge the fact the state “afforded the voluntary crossing does not make it any less voluntary” “Take that for what it is your honor It’s absurd” Caine responded Caine also asked the judge to suppress Garcia’s alleged confession to a pair of Ogden police detectives in the Arizona jail Caine said that because one of the officers spoke Spanish he served as interpreter when the situation deserved an independent interpreter not one bent on getting a confession from Garcia But Deputy Weber County
